Kling, J. Roethe OPPOSED: -- COMMUNICATION: Town Board, <br /> D.N.R. <br /> #1792. Appeal by Thomas Matson, agent for Lacey Estate for a variance from <br /> required lot width and lot area as provided by Sections 10.05(4) & 11.03(1) to <br /> permit boundary realignment of existing lots at 1989 Skyline Drive, being Lots <br /> 12, 13 and 14 - Cottage Park and additional lands - Sections 29 and 30, Town <br /> of Pleasant Springs. <br /> IN FAVOR: T. Matson OPPOSED: -- COMMUNICATION: Town Board. <br /> #1793. Appeal by Dolphin Pools, agent for John Cannarella for a variance from <br /> required setback from normal high watermark as provided by Section 11.03(2) to <br /> permit inground pool at 5164 Reynolds Avenue being Lot #25, 2nd Ward Beach, <br /> Section 28, Town of Westport. <br /> No appearances OPPOSED: D. Lewis COMMUNICATION: D.N.R., Town Board & <br /> petition from neighbors. <br /> Board rendered following decisions: <br /> #1785. Harvey/Quackenbush to hold in abeyance, as requested by applicant, to <br /> allow submittal of additional materials. Abeyance not to extend beyond <br /> January 26, 1989 public hearing. Motion carried - 3-0. <br /> #1786. Quackenbush/Harvey to grant with condition variance of 13 feet more or <br /> less from required setback right-of-way of CTH V to permit canopy over gas <br /> islands. • <br /> The canopy shall be removed at the owner's expense if future road improvement <br /> requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1) . Similar variances regularly granted. <br /> 2) . County Highway has no objection. • <br /> 3). Encroachment is 13 feet above grade. <br /> CONCLUSION: <br /> • 1) . Variance is necessary to provide right enjoyed by others. <br /> 2) . Variance is not contrary to rights of others or to the public interest. • <br /> Motion carried - 3-0. <br /> #1787. Harvey/Quackenbush to grant with condition. Variance of 10 feet more <br /> or less from required maximum height of sign also 70 feet more or less from <br /> sign distance from intersection to permit sign as constructed. <br /> CONDITION: <br /> A sign shall be removed at the owner's expense if future road improvement <br /> requires additional right-of-way. <br />
