Subject to Environmental Health Department approving location of pool <br /> relative to septic location. <br /> FINDING OF FACT: <br /> 1) . State Highway has expanded right-of-way with no present utilization of <br /> property. <br /> 2) . No objection received from State Highway Department. <br /> 3) . Locating pool on West side of residence would place it on "failed" septic <br /> system. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2) . Variance is necessary to provide right enjoyed by others. <br /> Co, Motion carried 4-0. <br />
