Quackenbush/Rendall to grant variance of 4 feet more or less from <br /> required setback centerline Class A Highway to permit new barn construction. <br /> FINDING OF FACT: <br /> 1) . New structure will replace old barn destroyed by high winds in same <br /> location. <br /> 2). New barn will utilize existing silo and feeder bunk. <br /> 3) . Other farm buildings presently encroach further into required road <br /> setbacks. <br /> CONCLUSION: <br /> 1) . Proven case unnecessary hardship. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 4-0. <br /> 11776. Harvey/Quackenbush to hold in abeyance until November 17th public <br /> hearing to allow affected parties to meet to try and resolve water run-off <br /> problems. <br /> Motion carried - 4-0. <br /> 11777. Harvey/Quackenbush to hold in abeyance until November 17th public <br /> hearing to allow applicant to approach D.N.R. in hopes of resolving some of <br /> their objections. <br /> Motion carried 4-0. <br /> CIF 11778. Quackenbush/Rendall to grant with condition variance of 16.4 feet more <br /> or less from required setback from right-of-way CTH Y to permit additions to • <br /> existing residence and setback variance of 28.1 feet more or less from <br /> right-of-way to permit construction of residence garage. <br /> Also, to grant variance of 30.1 feet more or less from required rearyard to <br /> permit additions to existing residence and variance of 28.1 feet more or less <br /> from required rearyard to permit construction of residence garage (variances <br /> include existing residences as they presently exist. ) <br /> Also, to grant variance of 5065.4 feet more or less from minimum required lot <br /> area to permit equal lot division. <br /> CONDITION: <br /> 1) . New building and residence additions shall be remove is at owner's <br /> expense if additional right-of-way are required. <br /> FINDING OF FACT: <br /> 1) . Lots and existing structures were non-conforming however subsequent CSM <br /> rendered lots not legal. <br /> 2). Variances needed for both residences as they exist in order for new CSM <br /> approval. <br /> 3). Proposed additions to residence and new accessory building will extend no <br /> nearer required setbacks or yards than do existing structures. <br /> 4) . Northern 1/2 of lot has no additions or alterations as per this variance. <br /> CONCLUSION: <br /> 1) . Hardship is caused by the ordinance and is not self-imposed. <br /> 2) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> . <br /> Motion carried - 4-0. <br />
