B.O.A./Minutes/8/25/88 <br /> Page 4 <br /> FINDING OF FACT: <br /> 1) . Existing residence is in violation since constructed 20+ years ago. <br /> 2). Lot is irregular shaped. <br /> 3) . No objection from neighbors. <br /> CONCLUSION: <br /> 1). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Carried - 4-0. <br /> #1744. Quackenbush/Jones to grant with conditions variance of 4.5 feet from <br /> required right sideyard of proposed Lot #3 also to grant variance of 17.4 more <br /> or less feet from required rearyard of proposed Lot #4. <br /> CONDITIONS: <br /> 1) . Variances (side and rearyard) area for existing structures only - any <br /> additions or replacement shall be located in complying location. <br /> FINDING OF FACT: <br /> 1) . Residences have been in existance for quite a period of time, prior to <br /> applicant acquiring property. <br /> 2). Variances are needed for approval of certified survey maps. <br /> 3). Upon rezone approval, to R-2, required rearyard of proposed Lot #4 shall <br /> be reduced. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Carried - 4-0. <br /> #1745. Quackenbush/Jones to grant variance with conditions of 8 feet from <br /> maximum height above normal high water mark to permit second level above <br /> boathouse also, grant variance of 824 square feet to permit 30' x 30 ' garage <br /> and second story over boathouse. <br /> CONDITIONS: <br /> 1). That nothing other than railing shall extend above the 20 foot height <br /> limitation of this variance. <br /> 2). Railing above boathouse shall not be a visionary obstruction. <br /> Quackenbush/Jones to grant special exception permit with conditions for bank <br /> stabilization and retaining walls. <br /> CONDITIONS: <br /> • <br /> 1). That plans and specifications be prepared by a licensed engineer within <br /> the scope of the application, and filed with the Zoning Department before <br /> commencement of any work. <br /> 2) . That all work be performed in compliance with approved engineering <br /> standards and all applicable governmental rules and regulations particularly <br /> Section 11.05(4) of Dane County Ordinance. <br /> 3). That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> FINDING OF FACT: <br /> 1). Unusually steep bank being 30 more or less feet above normal high <br /> watermark necessitates need for retaining structure landward of boathouse - <br /> n.`,, <br /> second story accomplishes retainment. <br />
