B.O.A./Minutes/8/25/88 <br /> Page 8 <br /> Quackenbush/Harvey to hold special exception request pending: 1. that plans <br /> and specifications be prepared by a licensed engineer within the scope of the <br /> application, and filed with the Zoning Department before commencement of any <br /> work. 2. that all work be performed in compliance with approved engineering <br /> standards and all applicable governmental rules and regulations particularly <br /> Section 11.05(4) of Dane County Ordinance. <br /> Carried - 4-0. <br /> Quackenbush/Jones to grant 7.4 more or less feet from required setback to <br /> normal high watermark to allow 16' x 32 ' addition to existing residence. <br /> FINDING OF FACT: <br /> 1). Existing residence is extremely small. <br /> 2). Adjoining owners have residences as close or closer however average <br /> setback 200 feet either side necessitates variance. <br /> CONCLUSION: <br /> 1). Variance is necessary to provide right enjoyed by others. <br /> 2). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> Carried - 4-0. <br /> #1758. Quackenbush/Jones to grant variance of 21 more or less feet from <br /> required setback to normal high watermark to permit additions to existing <br /> residence. <br /> Quackenbush/Jones to grant special exception permit in conditions for earth <br /> disturbing activity in conjunction with additions to residence. <br /> CONDITIONS: <br /> 1). Adequate culvert be installed if applicant wishes access across creek <br /> (subject to permits from all appropriate governmental units) . <br /> 2). That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> FINDING OF FACT: <br /> 1). Existing residence is almost entirely within required setback. <br /> 2). Applicant withdrew requested variance from setback to road. <br /> 3). W. Branch to Sugar River is only carrying water after spring and fall <br /> rains. <br /> 4). Residence is rather small as exists. <br /> 5). Property has low-spots where excavated materials could be deposited. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> SPECIAL EXCEPTION: <br /> 1). The project as planned, with specified conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> Carried - 4-0. <br /> Cre <br />
