Richard Johnson for a Special Exception Permit as <br /> provided by section 11.05(3) to permit filling, grading, etc. , within 300 feet <br /> of Lake Kegonsa beino on Lots 41 & 42 Colladay Point - Section 23, Town of <br /> Dunn. <br /> IN FAVOR: R. Johnson OPPOSED: -- COMMUNICATION: DNR(phone), Town Board. <br /> #1741. Appeal by Kevin Uphoff, agent for Holmgren & McKinstry for a Special <br /> Exception Permit as provided by Section 11.05(3) to permit filling, grading, <br /> etc. , within -300 feet of Lake Waubesa being on Lots 31 & 32 Block #1, Brictson <br /> Park - Section 8, Town of Dunn. <br /> IN FAVOR: K. Uphoff OPPOSED: -- COMMUNICATION: Town Board. <br /> Public hearing was closed and Board rendered the following decisions: <br /> #1727. Quackenbush/Earveyto hold in abeyance until August public hearing to <br /> enable applicant to provide specific plans; site plan, drainage plans and <br /> house plans for Town Engineer and Board of Adjustment review. Motion carried <br /> - 4-0. <br /> #1728. Quackenbush/Harvey to grant with conditions variances of 5 feet to <br /> sideyard being 125' in length, 6 feet to sideyard being 95 ' in length and _- <br /> grant variance of 28 more or less square footage from maximum allowable area <br /> of accessory buildings. <br /> CONDITIONS: Applicant shall provide Board with copy of letter confirming, <br /> with adjoining neighbor, that water run-off concerns have been addressed. <br /> FINDING OF FACT: <br /> 1. Lot configuration is rather prohibitive and buildable area limited. <br /> 2. Garage will replace unsitely metal building in same location. <br /> 3. Residence is built on slab without basement storage area. <br /> 4. Property is in an area of numerous nonconforming structures. <br /> CONCLUSION: <br /> 1. Variance is not contrary to rights of others or to the public interest. <br /> 2. Variance is necessary to provide right enjoyed by others. <br /> Motion carried - 4-0. <br /> #1729. Rendall/Quackenbush to grant variance of 12 more or less feet from <br /> required setback, from normal high watermark, tributary of Sugar River to <br /> permit accessory building as constructed. <br /> FINDING OF FACT: <br /> 1. Tributary to Sugar River is a meandering stream and its path changes. <br /> CONCLUSION: <br /> 1. Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 4-0. <br /> #1730. Harvey/Rendall to grant permit as per plan to relocate road and bridge <br /> construction. <br /> FINDING OF FACT: <br /> ri.rr 1. Plan by State Department of Transportation. <br /> 2. Project has State D.O.T. Engineering and State Inspection. <br />
