Open Pantry - Madison. <br /> Quackenbush/Rendall to grant reconsideration of August 25, 1988 action. <br /> Quackenbush/Rendall to grant amendment of conditions requiring closure of <br /> Northern most driveway onto Park Street to read as follows: <br /> 1. Directional driveway permitted to North end of property (as per plan <br /> submitted) allowing traffic to ingress from Park Street only. <br /> 2. A permanent type barrier be installed across Northern most driveway to <br /> prevent public ingress/egress until such time that concrete construction may <br /> commence. <br /> 3. Project fully completed within 6 months from granting. <br /> FINDING OF FACT: <br /> 1. Driveway is needed for fuel tanker access to tanks. <br /> 2. Proposed plan will prevent public traffic from exiting onto Park Street, <br /> yet provide fuel delivery to storage facility. <br /> 3. Plan has Town Board approval. <br /> CONCLUSION: <br /> 1. Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2. Variance is not contrary to rights of others or to the public interest. <br /> Carried - 4-0. <br /> #1782. Valenza - Dunn. <br /> 4110. Quackenbush/Jones to grant requested waiver of fee for reapplication of <br /> requested variance. <br /> Carried - 4-0. <br /> #1774. Endres - Vienna. <br /> Quackenbush/Rendall to hold in abeyance until January 26th public hearing <br /> pending resolution of sanitary question. <br /> Carried - 4-0. <br /> #1776. Freeman - Westport. <br /> Rendall/Quackenbush to grant permit for filling and grading as completed, to <br /> allow lot drainage after construction of single family residence. <br /> FINDING OF FACT: <br /> 1. East side of residence is serviced by below grade tubing to divert <br /> downspout water away from adjoining property. <br /> 2. Applicant provided professional engineer statement relieving Mr. Freeman <br /> of responsibility of adversely effecting adjoining property regarding water <br /> run-off from applicant's residential construction. <br /> 3. Buildings at the end of St. Cyr Road act as a dam and back water up onto <br /> the Mergen property. <br /> 4. Adjoining neighbor (Mergen) has failed to show evidence of adverse effect <br /> caused by construction of applicant. <br /> CONCLUSION: <br /> 1. The project as planned will not result in substantial detriment to <br /> navigable waters by erosion, sedimentation, impairment of fish or aquatic <br /> life, or safe and healthful conditions. <br /> Carried - 4-0. <br />
