Spoils removed from flood zone. <br /> CONCLUSION: <br /> 1. The project as planned, with specified conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> 2. The project as planned, with specified conditions will preserve the <br /> natural shoreline. Motion carried - 4-0. <br /> #1799. Harvey/Quackenbush to grant variance of 19 feet more or less from <br /> required rearyard to permit addition to residence as constructed. <br /> FINDING OF FACT: <br /> 1. Addition constructed in 1983 without required zoning permit. <br /> 2. Property has limited buildable area due to road setback and required <br /> rearyard. <br /> 3. No objection from township or State Highway Department. <br /> CONCLUSION: <br /> 1. Variance is not contrary to rights of others or to the public interest. <br /> Carried - 4-0. <br /> #1800. Rendall/Jones to hold in abeyance until January 26th public hearing to <br /> allow full Board to view property on next inspection trip. <br /> Carried - 4-0. <br /> #1801. Harvey/Quackenbush to hold in abeyance until February 23rd public <br /> hearing, as requested by township, to allow town discussion and input. <br /> Carried - 4-0. <br /> #1802. Quackenbush/Harvey to hold in abeyance to allow applicant to resolve <br /> septic, additions without permits and lot coverage questions. Abeyance not <br /> beyond February 23rd public hearing. Motion carried 4-0. <br /> #1803. Jones/Harvey to deny requested variance of required lot area to create <br /> buildable parcel. <br /> FINDING OF FACT: <br /> 1. Lot was created without benefit of certified survey at the time one was <br /> required. <br /> 2. Applicant failed to pursue acquisition of property from adjoining owners <br /> to meet minimum area needed. <br /> 3. Variance has been granted by township. <br /> CONCLUSION: <br /> 1. Unnecessary hardship was not proven. <br /> Carried - 3-1 (Quackenbush, no) . <br /> Appeals from previous hearings: <br /> #1678.
