Special Exception Permit is to prevent "ponding" of water around building <br /> project. <br /> CONCLUSION: <br /> 1) . Variance preserves the Zoning Ordinance as much as possible without <br /> injustice to applicant. <br /> 2) . Variance is necessary to provide right enjoyed by others. <br /> 3) . The project as planned will not result in substantial detriment to <br /> navigable waters by erosion, sedimentation, impairment of fish or aquatic <br /> life, or safe and healthful conditions. <br /> Motion carried - 4-0. <br /> #1614. Quackenbush/Miller to grant variance of 7 feet more or less from <br /> setback of Dorshorst Lane centerline to permit residence and accessory <br /> building as constructed. <br /> FINDING OF FACT: <br /> 1) . Both structures were built with permits - permits were issued in error. <br /> 2) . When certified survey was approved a waiver was granted to permit a <br /> substandard road. <br /> 3) . Structures meet setback from right-of-way but variance is needed for <br /> distance from centerline. <br /> CONCLUSION: <br /> 1) . Hardship is caused by the Ordinance and is not self-imposed. <br /> Motion carried - 4-0. <br /> #1615. Quackenbush/Miller to grant permit to reconstruct existing boat ramp <br /> from Lake Kegonsa. <br /> FINDING OF FACT: <br /> 1) . Project is intended to replace broken concrete of ramp. <br /> 2) . Town Board in favor. <br /> CONCLUSION: <br /> 1) . The project as planned will not result in substantial detriment to <br /> navigable wates by erosion, sedimentation, impairment of fish or aquatic life, <br /> or safe and healthful conditions. <br /> Motion carried - 4-0. <br /> #1616. Quackenbush/Miller to grant variance of 3 feet from required right <br /> sideyard to permit garage addition to existing residence. <br /> FINDING OF FACT: <br /> tor1) . Addition will be set further from side lot line than existing residence. <br /> 2) . Mature trees limit location of proposed garage. <br />
