Septic area be located not nearer than 10' from existing highway <br /> right-of-way. <br /> 2) . That all government approvals pertaining to septic systems are obtained. <br /> FINDING OF FACT: <br /> Variance: 1) . Proposed addition is further from road Than existing structure. <br /> 2) . County Highway has no objection. <br /> Special Exception: 1) . Replacement septic system is needed and site has <br /> limited suitable area. <br /> CONCLUSION: <br /> Variance: 1) . Variance is not contrary to rights of others or to the public <br /> interest. <br /> 2) . Hardship is caused by the Ordinance and is not self-imposed. <br /> Special Exception: 1) . The project as planned, with specified conditions; <br /> will not result in substantial detriment to navigable waters by erosion, <br /> sedimentation, impairment of fish or aquatic life, or safe and healthful <br /> conditions. <br /> Motion carried - 4-0 . <br /> #1650. Goodman + Beery - Albion. <br /> Jones/Quackenbush to grant variance of 3 more or less feet from required left <br /> sideyard also grant variance of 18 more or less feet from required rearyard to <br /> permit additions as constructed. <br /> FINDING OF FACT: <br /> 1) . Additions were constructed many Years ago (15 more or less) without <br /> permits or variances. <br /> 2) . Is in an area of numerous non-conforming structures. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 4-0. <br /> Petitions held from previous hearings: <br /> #1623. Rio - Pleasant Springs - 10/22/87 public hearing. <br /> Quackenbush/Miller to deny variances to sideyard and setback from road. <br /> Quackenbush/Miller to grant variance of 724 square feet from maximum allowable <br /> square footage of accessory buildings to permit existing 10' x 10' storage <br /> building plus allow 24 ' x 26 ' garage to be constructed. <br /> FINDING OF FACT: <br /> 1) . Applicant has small lake lot without suitable area for garage. <br /> 2) . Subject property is across road from applicants residence. <br /> 3) . Subject property is vacant lot with sufficient buildable area without <br /> need for location variances. <br /> CONCLUSION: <br /> Sideyard + Setback: <br /> 1) . Unnecessary hardship was not proven. <br /> Square Footages: <br /> 1) . Variance is necessary to provide right enjoyed by others. <br /> 2) . Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 4-0. <br />
