Variance #1305 for structure was granted 11/15/84 - however permit was <br /> never obtained. <br /> 2). County Highway already has 156 feet of right-of-way to South side CTH TT <br /> and has no objection to garage as proposed. <br /> 3) . Existing structure on proposed location to be removed. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 5-0. <br /> #1510. Mathison - Dunn - (w/conditions) <br /> Quackenbush/Miller to approve (with conditions) variance of 4 feet from <br /> required setback from normal high watermark to allow deck addition to existing <br /> boathouse also to grant special exception permit to allow stairs/retaining <br /> walls and shoreline stabilization as constructed. <br /> CONDITIONS: <br /> Subject to no objection from Department of Natural Resources as to location of <br /> deck. <br /> FINDING OF FACT: <br /> 1) . Structure was existing - deck is only addition requiring setback variance. <br /> 2) . Stairs are replacement of existing in need of repair. <br /> 3). Earth disturbing activity, in association with stairway construction, is <br /> minimal. <br /> 4). Deck does not obstruct view of lake to any adjoining property owners. <br /> CONCLUSION: <br /> 1) . Variance is not contrary to rights of others or to the public interest. <br /> 2) . Special Exception Permit granted, as per completed, project will not <br /> result in substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions also will <br /> preserve the natural shoreline. <br /> Motion carried - 5-0. <br /> #1511. Kalscheur - Dunn. <br /> Jones/Miller to grant of 3.05 feet from maximum height of boathouse also grant <br /> special exception to permit shoreline stabilization as proposed. <br /> FINDING OF FACT: <br /> 1) . Applicant has made every attempt to construct boathouse within allowable <br /> limits; surveyor determined normal high watermark prior to construction. <br /> 2). Error appears to be on part of contractor. <br /> 3) . Boathouse is built into bank and roof is covered with dirt providing no <br /> obstruction of view. <br /> tly 4). Special Exception is for minimal bank stabilization necessary after <br /> boathouse construction. <br />
