Requirement of applicant to dedicate additional right-of-way necessitates <br /> variance. <br /> CONCLUSION: <br /> 1) . Variance preserves the Zoning Ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Hardship is caused by the Ordinance and is not self-imposed. <br /> Motion carried - 5-0. <br /> Petitions Held in Abeyance: <br /> #1481. McMeen - Vermont. <br /> Kruschke/Miller to approve Special Exception Permit with conditions to permit <br /> fill and grade within 300 feet of Moen Creek to permit: <br /> CONDITIONS: <br /> 1) . Permit granted as per plans submitted. <br /> 2) . The filled and/or graded and disturbed areas shall be sodded or seeded <br /> with fast growing grasses and mulched to prevent siltation or erosion. <br /> 3) . The applicant shall request inspection by the Dane County Zoning <br /> Department upon completion of the project. <br /> FINDING OF FACT: <br /> 1) . Applicant submitted engineering statement as requested by Board. <br /> 2) . Engineer supports project as completed. <br /> 3) . Inspection by Zoning Department confirms conditions: <br /> CONCLUSION: <br /> 1) . The project as planned with specified conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> #1339/1444 Requested reconsideration - Howard - Westport. <br /> T. L. Howard & Attorney Dan Sinykin addressed the Board. <br /> Quackenbush/Kruschke to find new evidence to permit reconsideration of denial <br /> as per 10.26 (10) , based upon revised normal high waterline elevation by <br /> Department of Natural Resources. <br /> Motion carried - 5-0. <br /> Miller/Jones to adjourn.
