Hellenbrand - Westport. <br /> Miller/Kruschke to deny due to applicant's failure to appear at public hearing. <br /> Motion carried - 5-0. <br /> OTHER BUSINESS: <br /> Board member Kruschke addressed Board regarding William Rettenmund - Black <br /> Earth request for no enforcement of Zoning Ordinance while he replaces an <br /> essential barn cleaner conveyor located too close to right-of-way, while <br /> variance is pending. <br /> Kruschke/Miller to request Zoning Department Staff to take no enforcement <br /> action against Mr. Rettenmund for continued construction. <br /> Motion carried - 5-0. <br /> PETITION HELD IN ABEYANCE : <br /> #1498. Kast/Burke - 10/23/86 public hearing. <br /> Jones/Miller to deny requested variances due to failure to find hardship. <br /> FINDING OF FACT: <br /> 1 ) . Property, as exists, is over maximum allowable square footage of <br /> accessory buildings, many of which are unusable. <br /> 2). Applicant is unwilling to remove unusable existing structures at this <br /> time. <br /> CONCLUSION: <br /> 1 ) . Unnecessary hardship was not proven. <br /> Motion carried - 5-0. <br /> #1515. Welch/Pleasant Springs - 11/20/86 public hearing <br /> Quackenbush/Miller to grant, as modified, variances of 15 feet more or less <br /> from required setback from Williams Point Drive. Also, variance of 960 square <br /> feet from maximum allowable square footage of accessory buildings to allow <br /> construction of residential garage. <br /> FINDING OF FACT: <br /> 1 ) . Existing residence is 1 story former summer cottage with no basement. <br /> 2) . Garage is needed for watercraft and accessories, also vehicle storage. <br /> 3). Garage will extend into setback no closer than adjoining property also <br /> numerous others in area. <br /> CONCLUSION: <br /> 1 ) . Variance preserves the Zoning Ordinance as much as possible without <br /> injustice to applicant. <br /> 2).
