Anderegg - Springfield. <br /> Schwahn/Kruschke to deny variance from requested setback for residential <br /> garage. <br /> FINDING OF FACT: <br /> 1) . There is sufficient area to locate garage without need for variance. <br /> 2) . Similar variance request to neighboring property was denied. <br /> CONCLUSION: <br /> 1) . Unnecessary hardship was not proven. <br /> Motion carried. 5-0. <br /> #1422. Barman - Springfield. <br /> Schwahn/Kruschke to hold in abeyance request of Special Exception Permit <br /> pending a statement of consent with property owner and resolving objection <br /> from Department of Natural Resources. <br /> Motion carried. 5-0. <br /> #1423. Edgerton Oasis, Inc. - Albion. <br /> Miller/Jones to grant variance of 3 feet more or less from required setback <br /> from Haugen Road to permit addition to existing service station. <br /> FINDING OF FACT: <br /> 1) . Location of existing building and setback restrictions create problem. <br /> 2) . Denial of variance would restrict and diminish the only usable area <br /> available for repair garage facility. All other areas for potential <br /> addition to building are prevented by in-ground tanks, service <br /> islands, etc. <br /> CONCLUSION: <br /> 1) . Variance preserves the Zoning Ordinance as much as possible without <br /> injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. 4-1, Kruschke no. <br /> OTHER BUSINESS: <br /> Board met with Darrel Langer, Medina Chairman and James Lewellen regarding <br /> Appeal #1410 for Waterloo Malting Company. Mr. Lewellen claims Special <br /> Exception Permit #1410 fraudulently obtained as Waterloo Malting Company had <br /> no authority to act as his agent. <br /> Schwahn/Jones to rescind action of October 24, 1985 in granting Special <br /> Exception Permit #1410 pending resolution of differences between Waterloo <br /> Malting C ow.=amo Mme.
