B.O.A./Minutes/11/21/85
Page 4
#1417. Kohler - Medina.
Kruschke/Jones to grant variance of 3 feet more or less from required sideyard
and 16 feet more or less from required setback from Berlin Road to allow
addition to existing residence.
FINDING OF FACT:
1) . Area of numerous nonconforming structures.
2) . Addition will not extend nearer to side lot line or road setback than
existing building.
CONCLUSION:
1) . Variance preserves the Zoning Ordinance as much as possible without
injustice to applicant.
2) . Hardsnip is caused by the Ordinance and is not self-imposed.
Motion carried. 5-0.
#1418. Cummings - Medina.
Miller/Schwahn to deny variance from required setback from road for
residential garage.
FINDING OF FACT:
(rie 1) . Tree plantings are of insignificant size (3-4 foot) to prevent
relocating.
2) . Large lot has enough area to allow building in conforming location.
CONCLUSION:
1) . Unnecessary hardship was not proven.
Motion carried. 5-0.
#1419. Hacker - Berry/Springfield.
Schwahn/Kruschke to grant variance of 14 feet more or lessKto allow addition
to existing tavern. 11\\
1) . Majority of existing structure is closer to centerline than proposed
addition.
2) . Relocating to complying location virtually impossible due to severe
slope.
CONCLUSION:
1) . Proven case of unnecessary hardship.
2) . Variance preserves the Zoning Ordinance as much as possible without
injustice to applicant.
Motion carried. 5-0.
#1420. Reinders - Pleasant Springs.
Jones/Schwahn to hold in abeyance Special Exception Permit request, pending
statement of impact upon adjacent properties and run-off and a plan by a
landscape architect of proposed bank retaining structure, walkways and any
improvements.
Motion carried. 5-0.
L
