Board of Adjustment/Minutes/12-19-85 <br /> Page 3 <br /> setback from right-of-way of CTH V to allow construction of farm accessory <br /> building. <br /> FINDING OF FACT: <br /> 1) . County Highway already has expanded right-of-way on this portion of <br /> highway and has no objection to proposed building. <br /> 2) . Proposed building will be no closer than other existing buildings. <br /> CONCLUSION: <br /> 1) . Variance is not contrary to rights of others or to the public <br /> interest. <br /> 2) . Variance preserves the Zoning Ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried, 5-0. <br /> #1426. Malisch - Springfield. <br /> Kruschke/Miller to grant with conditions Special Exception Permit to place <br /> fill and grade for driveway to proposed residence. <br /> CONDITIONS: <br /> 1) . Applicant to provide to Dane County Zoning Department with <br /> verification of flood zone location. <br /> 2) . Obtain flood zone permit, if one is found to be required. <br /> Cler 3) . The filled and/or graded and disturbed areas shall be sodded or <br /> seeded with fast growing grasses and mulched to prevent siltation or <br /> erosion. <br /> 4) . The applicant shall request inspection by the Dane County Zoning <br /> Department upon completion of the project. <br /> CONCLUSION: <br /> 1) . The project as planned, with specified conditions; will not result <br /> in substantial detriment to navigable waters by erosion, <br /> sedimentation, impairment of fish or aquatic life, or safe and <br /> healthful conditions. <br /> Motion carried, 5-0. <br /> #1427. Rasmussen - Burke. <br /> Miller/Schwahn to grant variance of 13 feet more or less from required setback <br /> from road to allow existing bhuilding after plat approval. <br /> FINDING OF FACT: <br /> 1) . Application is for reapproval of previous granted variance where <br /> plat was not recorded. <br /> CONCLUSION: <br /> 1) . Variance preserves the Zoning Ordinance as much as possible without <br /> injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried, 5-0. <br /> (iew #1428. Barnett - Deerfield. <br /> Schwahn/Kruschke to deny variance from unlimited livestock on less than 5 <br /> acres. <br /> FINDING OF FACT: <br /> 1) . Village of Deerfield in opposition. <br />
