Board of Adjustment/Minutes <br /> Page 5 <br /> CONDITIONS: { <br /> 1) . The building shall be removed at the owners expense if future road r. <br /> improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1) . Soil suitability and natural drainage way restrict buildable area. <br /> 2) . County Highway has no objection as they feel they have more than <br /> sufficient right-of-way for future projects. <br /> CONCLUSION: <br /> 1) . Variance preserves the Zoning Ordinance as much as possible without <br /> injustice to applicant. <br /> 2) . Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried, 5-0. <br /> Special Exception & Variances - Held in Abeyance: <br /> #1422 - Barman - Springfield. <br /> Schwahn/Kruschke to deny request for new ditching of tributary to Six Mile <br /> Creek. <br /> Schwahn/Kruschke to permit clean-out of existing tributary to Six Mile Creek <br /> subject to conditions: <br /> CONDITIONS: <br /> 1) . Project will be done under Department of Natural Resources <br /> guidelines. <br /> 2) . All spoils shall be spread and leveled. <br /> 3) . Applicant will obtain flood zone permit prior to commencing project. <br /> 4) . The applicant shall request inspection by the Dane County Zoning <br /> Department upon completion of the project. <br /> CONCLUSIONS: <br /> 1) . Dredging and clean-out of ditches is necessary to provide proper <br /> drainage of existing field. <br /> 2) . The project as planned, will not result in substantial detriment to <br /> navigable waters by erosion,sedimentation, impairment of fish or <br /> aquatic life, or safe and healthful conditions. <br /> Motion carried, 5-0. <br /> Miller/Voges to adjourn at 9:03 p.m. <br /> Motion carried, 5-0., RECEIVED <br /> Steven H.
