Dane County Zoning and Natural <br /> Resources Committee <br /> May 25, 1993 <br /> Page 2 <br /> Zoning Petition No. 5622 . They also advised you and the <br /> Committee that "the current status of Zoning Petition No. 5622 is <br /> that the Town of Westport Board has not taken any action based on <br /> the merits of such zoning petition due to potential violations of <br /> the Wisconsin Open Meeting Law and code of ethics provisions <br /> applicable to local government officials contained in chapter 19 <br /> of the Wisconsin Statutes. " The attorneys then go on to discuss <br /> these alleged problems as they see it in some detail. That is <br /> simply not the reason why the Town Board did not take action on <br /> the zoning petition by the Fagas. As noted above, the Town Board <br /> was asked by the Fagas not to take action. <br /> In addition, the Town would certainly like to take the <br /> opportunity to review the Fagas ' amendment to the zoning <br /> petition. The Town Board is again to consider this matter on <br /> June 7, 1993 . Perhaps at that Board meeting, the Town will take <br /> specific action as to the rezoning. The Town will then advise <br /> you of its action after that meeting. <br /> Accordingly, we would ask that the Dane County Zoning and Natural <br /> Resources Committee not take action with respect to Zoning <br /> Petition No. 5622 at its meeting on May 25, 1993 . The Town has <br /> at this point voted to hold this in abeyance so that it can <br /> review this matter with legal counsel, and because it was <br /> requested to do so by the petitioners. The Town will likely take <br /> action on this matter on June 7, 1993, and will advise the County <br /> of its decision with respect to the rezoning. <br /> Please distribute the attached copies of this letter to the <br /> various Dane County Zoning and Natural Resources Committee <br /> members prior to or at tonight's meeting. We also ask that this <br /> letter become part of the record for review at the May 25, 1993 <br /> meeting. <br /> TGW26,V <br />
