Town or County institutes any judicial action <br /> against any owner for the same, then said <br /> violating owners shall be further responsible for <br /> costs, disbursement and expenses, including actual <br /> and reasonable attorney's fees, incurred in the <br /> enforcement of these reservations and restrictions <br /> if judgment is entered in favor of the Town or <br /> County in such action. <br /> 2. Failure of the Town or County or any person to <br /> • enforce any provision of these restrictions shall <br /> in no event be deemed a waiver of the right to <br /> enforce thereafter. <br /> D. Third-Party Enforcement. Additionally, the <br /> restrictions on the property contained in this document <br /> shall run in favor of the owners of the property and <br /> the owners of all lands located within 3000 feet of the <br /> property, and the owners of such lands shall have the <br /> right to enforce these restrictions in accordance with <br /> section C. , above, except that each such owner shall be <br /> responsible for its own costs, disbursement and <br /> expenses, including reasonable attorney fees. <br /> E. Lot Restriction. Other than the creation of four <br /> single family residential lots on the property by <br /> certified survey map, which certified survey map shall <br /> require all necessary governmental approvals, no <br /> further land division shall be allowed for the <br /> property, and at no time shall the total number of <br /> single family residential dwellings located on the <br /> property be more than four. <br /> F. Attach To Map.
