TOWN OF WESTPORT <br /> RESOLUTION NO. `?3-6.3 <br /> A RESOLUTION APPROVING A REZONING FOR CERTAIN PROPERTY <br /> IN THE TOWN OF WESTPORT, DANE COUNTY, WISCONSIN <br /> WHEREAS, application has been made for a rezoning for the <br /> property described on Exhibit A attached hereto and incorporated <br /> herein by reference; and <br /> WHEREAS, the proper public hearings have been held on the <br /> granting of the rezoning and any notices as required by law have <br /> been provided; and <br /> WHEREAS, the Town Board hereby approves with conditions and <br /> revisions a rezoning for the property, which revisions and <br /> conditions the landowners have expressly indicated are acceptable <br /> and so will abide by the same; <br /> NOW, THEREFORE, the Town Board of Supervisors of the Town of <br /> Westport, Dane County, Wisconsin, does hereby resolve to approve <br /> the rezoning of the following property, with specific conditions <br /> and restrictions, as follows : <br /> Section 1 . The property described on Exhibit A attached <br /> hereto and incorporated herein by reference is hereby approved to <br /> be rezoned RH-1 for that portion of the property shown as Lots 1, <br /> 2 and 4 of Exhibit B, and RH-2 for that portion of the property <br /> shown as Lot 3 of Exhibit B . <br /> Section 2 . The above rezoning approval is conditioned upon <br /> the following, and if any one of the following are not met by the <br /> specific dates so noted, the rezoning of the property in Section <br /> 1 above shall not become effective, and the property shall retain <br /> its RH-3 zoning classification. <br /> A. The above rezoning is conditioned upon the present <br /> property owners (Craig and Janice Faga) obtaining <br /> approval from the Town of Westport for a land division <br /> of the property described at Exhibit A in substantial <br /> conformance with the land division shown at Exhibit B <br /> hereto, and the meeting of any reasonable and lawful <br /> conditions placed upon such land division by the Town, <br /> which conditions must be met for the above rezoning to <br /> be effective. <br /> B. In connection with the approval of the land division <br /> noted above, if such approval is obtained, the owners <br /> and the Town of Westport shall enter into a development <br /> agreement mutually acceptable to the parties prior to <br /> TGW29, Z <br /> 14 A-- 1 <br />
