ORDINANCE AMENDMENT NO. 5642 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> COTTAGE GROVE / SUN PRAIRIE <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Cottage Grove and Sun Prairie be amended to <br /> include in the R-1 Residential and RH-4 Rural Homes District the following <br /> described land: <br /> Part of the SE 1/4 SE 1/4 Section 33 and NE 1/4 NE 1/4 Section 4, Town of <br /> Cottage Grove described as follows: <br /> TO R-1 : Commencing at a point in the centerline of Gaston Road which is also <br /> the Southwest corner of CSM #5517, Lot #2, thence S 51° 35' 30" West 35.4 feet <br /> along the centerline of Gaston Road to the intersection with the North line of <br /> Section 4, Town of Cottage Grove and the point of beginning. Thence continue S <br /> 51 ° 35' 30" West 84 feet more or less along the said centerline to the West <br /> line; thence S 38° 05' East 432 feet; thence N 51° 35' 30' East 100 feet; <br /> thence N 38° 05 ' West 420 feet to the North line of Section 4, Cottage Grove; <br /> thence Westerly 20 feet more or less along the said North line Section 4 to the <br /> centerline of Gaston Road and the point of beginning. <br /> TO RH-4: Part of the SE 1/4 SE 1/4 Section 33, Town of Sun Prairie, that part <br /> of the SE 1/4 SE 1/4 Section 33 lying Southerly and Westerly of Gaston Road. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed R-1 description is intended to describe land for which a <br /> certified survey map will be prepared for approval and recorded. This <br /> amendment will become effective, if within 90 days of its approval by Dane <br /> County, a certified survey map that describes the land to be rezoned is <br /> recorded in the office of the Dane County Register of Deeds. Failure to <br /> record the survey will cause the rezone to be null and void. <br /> CONDITION <br /> 1 . This amendment will become effective, if within 90 days of its approval <br /> by Dane County, a declaration shall be recorded in the office of the <br /> Dane County Register of Deeds on the titles of the subject properties, <br /> said declaration shall advise the following: <br /> A. The Blackhawk airport is located approximately 1/4 mile to the East, <br /> fly over by aircraft is to be expected and, <br /> B. Gaston Road is utilized by the customers of Blackhawk Airport and <br /> increased traffic is to be expected. <br /> 2. Failure to record the declaration will cause the rezone to be null and <br /> void. <br /> EFFECTIVE DATE: <br />
