• <br /> ORDINANCE AMENDMENT NO. 5644 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> CROSS PLAINS <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Cross Plains be amended to include in the <br /> R-lA Residential District the following described land: <br /> Part of the NE 1/4 NW 1/4 Section 34, Town of Cross Plains described as <br /> follows: Commencing at the Northwest corner of said Section 34; thence East, <br /> 1319.66 feet to the point of beginning; thence continuing East, 47.24 feet; <br /> thence South 39.50 feet; thence S 04° 38' 00" East, 62.65 feet; thence S 31 ° <br /> 32' 00" East, 172.22 feet; thence N 66° 13 ' 24" East, 136.64 feet; thence along <br /> the arc of a curve to the right having a radius of 699.00 feet and a long chord <br /> bearing S 08° 41 ' 16" East, 110.32 feet; thence S 55° 29 ' 05" West, 208.97 <br /> feet; thence S 78° 00' 00" West, 110.00 feet; thence N 00° 33' 14" West, 444.00 <br /> feet to the point of beginning. Also, commencing at the Northwest corner of <br /> said Section 34; thence East, 1319.66 feet; thence S 00° 33' 14" East, 444.00 <br /> feet to the point of beginning; thence N 78° 00' 00" East, 110.00 feet; thence <br /> N 55° 29' 05" East, 208.97 feet; thence along the arc of a curve to the right <br /> having a radius of 699.00 feet and a long chord bearing S 00° 21 ' 53" West, <br /> 110.33 feet; thence N 85° 06'32" West, 85 .00 feet; thence along the arc of a <br /> curve to the right having a radius of 614.00 feet and a long chord bearing S <br /> 25° 48' 46" West, 438.51 feet; thence N 00° 33' 14" West, 356.58 feet to the <br /> point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3) (a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions and restrictions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description is intended to describe land for which a <br /> certified survey map will be prepared for approval and recorded. This <br /> amendment will become effective, if within 90 days of its approval by Dane <br /> County, a certified survey map that describes the land to be rezoned is <br /> recorded in the office of the Dane County Register of Deeds. Failure to <br /> record the survey will cause the rezone to be null and void. <br /> CONDITION <br /> 1 . The 150 foot dimension of the highway right-of-way line around the <br /> inside curve of C.T.H. "P & S" on this parcel shall be field surveyed <br /> and clearly marked, including a marker on the highest point of the <br /> bluff-top transected by the highway right-of-way line, so that no county <br /> owned land is infringed upon by any future construction. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> 1 . The rooftop height of any new residence constructed on the proposed <br /> parcel "B" must be 24 feet below the top of the hill (bluff) which lies <br /> directly South of the new residence. <br /> (1 ) <br />
