Motion carried unanimously. Tim noted that the joint well, water and access <br /> agreements mentioned at that meeting during review of the request by the Glenn F. Jr. and Elaine M. <br /> Morrick Revocable Trust have now been executed. <br /> Susan Christensen was present to discuss the first agenda item, which was a request to exchange acreage <br /> and zoning districts between adjacent parcels located along Fritz Road in Section 6 that are owned by <br /> Susan and by Michael P. and Luann L. Zimmerman. <br /> The request is to reduce Susan's current 35.879 acres of Al-Exc. land by 26.97 acres,leaving 8.9 acres <br /> to be rezoned to RH-3. Simultaneously,the 26.97 acres would be added to the Zimmerman's current <br /> 8.316 acres resulting in 35.286 acres to be rezoned to Al-Exc. Exact acreage will be finalized during county review. <br /> The total number of Al-Exc. acres in the township will change only slightly as a result of this request. <br /> Because there continue to be no further divisions available on this land,the existing deed restriction on <br /> the Christensen land prohibiting another residence remains in effect but would be reassigned to the <br /> proposed new Zimmerman parcel. <br /> Deb mentioned that approval of earlier land use requests by the Christensens and Zimmermans stated <br /> that the converted barn residence on Lot 2 qualified as the farm home, which requires 35 acres or more <br /> of Al-Exc. land and the ability to meet the County's farm income requirement. <br /> Roger Lane at Dane County told Junior that it was acceptable to shift acreage,zoning districts, and the <br /> deed restriction between these two parcels, saying that the Zimmerman residence would be regarded as a <br /> pre-existing nonconforming use and would therefore be exempted from farm income requirements. <br /> Susan could not recall if she currently provides documentation of meeting this requirement. <br /> Junior moved to recommend town board approval of the swap of lands located along Fritz Road <br /> in Section 6 belonging to Michael and Luann Zimmerman and Susan Christensen as follows: <br /> 26.97 acres of Al-Exc. land will be added to the Zimmerman's existing RH-3 land to create a new <br /> parcel in excess of 35 acres, all to be zoned Al-Exc.
