• <br /> • <br /> "A use of property or course of conduct that interferes with the - <br /> legal rights of others by causing damage, annoyance, or <br /> inconvenience." <br /> The reduction of our property value while our taxes remain high is truly an interference <br /> of our legal rights and the use of the rezoning of this Lot to allow the storage of semi- <br /> tractors and trailers is in legal violation of the "Restrictions and Covenants" that govern <br /> the use of this property. Beyond this, it is important to remember that this is a housing <br /> development that is home to many children ranging from newborn through teens. <br /> There is great concern among the residents for the safety of children riding bicycles, <br /> walking, crossing streets, etc. with the entry and exit, on a daily basis, of a semi-tractor <br /> and trailer on the roadways of this development. <br /> There are other properties in this neighborhood used for the raising of horses, etc. <br /> However, the owners of these properties showed good faith to their neighbors by <br /> petitioning the neighbors prior to any deviations from the "Restrictions and Covenants" <br /> and asked for a variance to be approved by the neighbors. In the case you are <br /> reviewing, the semi-tractor and two trailers were moved in and imposed on the <br /> neighborhood in violation of the "Restrictions and Covenants" without approaching the <br /> neighbors. When found in violation, no effort was made to amend the violation. Two <br /> trailers and a semi-tractor reside on this property to this date. <br /> Although the owners of this property have now finally petitioned some residents to <br /> approve their violation, please check the addresses of those signing any approval and <br /> you will find that most do not have a direct view of their property. Other signatures are <br /> from individuals who have only recently moved into the neighborhood and do not have <br /> a full comprehension of how they will be impacted by this rezoning. We find the sight <br /> of the semi-tractor and trailers that we see, on a daily basis, from our living room, <br /> dining room, kitchen, and bedroom windows to be an annoyance. When we <br /> purchased our property we were required to know the legal restrictions put on the use <br /> of our property. We feel that the owners of Lot 3 were legally responsible to know the <br /> restrictions on their property. It should not now be the responsibility of the <br /> neighborhood to bear the burden of proving why the owners of Lot 3 should be denied <br /> this rezoning. <br /> Please deny this request for rezoning on the basis that it violates legal documents on <br /> record with Dane County and beyond that please take into consideration the impact <br /> that this rezoning will have on the safety and property values of the neighborhood. <br /> Sincerely, <br /> 07)72.eA4A--- <br /> Mr. and Mrs. Ian C.
