<br /> ARTICLE I
<br /> PREAMBLE
<br /> KNOW ALL MEN BY THESE PRESENTS, that the undersigned, T. W. WEBER
<br /> DEVELOPMENT PARTNERSHIP, a Wisconsin partnership, the owner of said
<br /> lots described above, for the purpose of preserving the value of the
<br /> lots aforesaid and surrounding lots, does hereby declare and provide
<br /> that said lots shall be used only. for the purposes and in the manner
<br /> set forth hereinafter, and shall be subject to the following restrictions,
<br /> covenants, and conditions, for the term and time hereinafter specified.
<br /> ARTICLE II
<br /> • AREA COVENTANTS
<br /> A. LAND USE AND BUILDING TYPE. Thece lots may be used for a residence
<br /> and to breed, keep and maintain livestock as further provided herein. No
<br /> building shall be erected, altered, placed, or permitted to remain on each
<br /> of said lots other than one detached single-family dwelling not to exceed
<br /> three (3) stories in height and a private garage for not less than two
<br /> (2) cars. Said garage shall be attached to the dwelling, except in cases
<br /> where the Architectural Control Committee determines the same to be
<br /> impractical or undesirable to attach said garage to the dwelling, and
<br /> two (2) outbuildings, not to exceed two (2) stories in height and not
<br /> to exceed 2,000 sq. ft. in useable floor space each, will b, permitted
<br /> on each of said lots, subject to the approval of the Architectural
<br /> Control Committee as described in Article III.
<br /> B. ARCHITECTURAL CONTROL. No building shall be erected, placed, or
<br /> altered on said lots until the construction plans, exterior elevation,
<br /> specifications (including driveway location and materials) and a plan
<br /> showing the location of the structure on the lots, including set back from
<br /> the street, side yards and rear years, has been approved, at its
<br /> discretion, by a majority of the Architec.kural Control Committee as to
<br /> quality of workmanship and materials, harmony of external design with
<br /> existing structures in the area, and as to location with respect to
<br /> topography and finish grade elevation.
<br /> C. EASEMENTS. No structure, planting, or other materials shall be placed
<br /> or permitted to remain within any easement of record which may damage or
<br /> interfere with the installation and maintenance of utilities, or which may
<br /> change the direction of flow of drainage channels in the easement. Any
<br /> easement on said lots and al improvements in it shall be maintained
<br /> continuously by the owner, except for those improvements for which a public
<br /> authority or utility company is responsible.
<br /> D. NUISANCES. Except as specifically provided in paragraph F, Article
<br /> II no noxious or offensive activity shall be carried on upon said lots, nor
<br /> shall anything be done thereon which may be or may become an annoyance or
<br /> nuisance to the neighborhood. The growing and production of field crops
<br /> and the use for gardens shall not be prohibited.
<br /> E. TEMPORARY STRUCTURES. No structures of a temporary character,
<br /> trailer, basement, tent, shack, garage, barn, or other building shall be
<br /> used on the lots at any time as a residence, either temporarily or
<br /> permanently.
<br /> F. ANIMALS. Cattle, horses, ponies, mules, poultry, sheep, and other
<br /> animals may be raised, bred or kept on said lots, provided that said
<br /> livestock shall not exceed one (1) animal unit for each full acre of lots
<br /> area, and further provided that a legal fence is constructed and
<br /> maintained as provided in Section H, Article II. All runoff water that
<br /> is polluted with animal wastes shall be prevented from reaching adjacent
<br /> lots or lands and public waters by diverting to and storing polluted
<br /> waters in non-critical areas or ponds. In addition, manure shall not
<br /> be stored so as to create an insect, vermin or odor nuisance for any .Q,
