• <br /> • <br /> vol 5714 art 51. <br /> G. GARBAGE AND REFUSE DISPOSAL. The lots shall not be used or <br /> • <br /> maintained as a dumping ground for rubbish. Trash, garbage, or other <br /> waste shall not be kept except in sanitary containers. All incinerators or <br /> other equipment for the storage or disposal of such material shall be kept <br /> in a clean and sanitary condition and screened from the slew of adjacent <br /> lots. <br /> H. FENCES. The land owner shall keep and maintain, at his expense, a <br /> partition fence of at least the standards of a legal fence, as specified in <br /> Section 90.02, Wisconsin Statutes, between his lot and adjoining lots, <br /> if said owner, or the owr r of adjacent lots use land for keeping of <br /> animals. <br /> I. BUILDING MATERIALS STORAGE. No building material of any kind or <br /> character shall be stored upon said lots except in connection with <br /> construction of an improvement approved by the architectural Control <br /> Committee as hereafter provided. Construction, of any improvement shall <br /> be promptly commenced and be diligently pursued as soon as any building <br /> materials are placed on said lots. <br /> J. ANTENNAS. No exterior television or radio receiving or transmission <br /> antennas or satellite signal receiving station or dish shall be placed or <br /> maintained upon any portion of the lots without prior written approval <br /> of the Architectural Control Committee. <br /> • <br /> K. SOLAR ORIENTATION FOR STRUCTURES. No active solar collector or <br /> apparatus may be installed on said lots unless such installation is first <br /> approved in writing by the Architectural Control Committee which shall <br /> consider the aesthetic and reflection effects on the neighborhood. If <br /> approved, collectors or apparatus installed flat or parallel to the <br /> plane of the roof shall be preferred. <br /> ARTICLE III <br /> ARCHITECTURAL CONTROL COMMITTEE <br /> A. MEMBERSHIP. The Architectural Control Committee is composed of the <br /> following persons: <br /> Thomas W. Weber 5609 Medical Circle <br /> Madison, Wisconsin <br /> Joseph R. Weber 2114 N. Sherman Avenue <br /> Madison, Wisconsin <br /> David M. Roark 2114 N. Sherman Avenue <br /> Madison, Wisconsin <br /> A majority of the committee may designate a representative to act for it. <br /> In the event of the death or resignation of any member of the committee, <br /> the remaining members shall have full authority to designate a successor. • <br /> Neither the members of the committee nor its designated representative <br /> shall be entitled to any compensation for services performed pursuant to <br /> this covenant. <br /> B. PROCEDURE. The committee's approval or disapproval, as required in <br /> these covenants, shall be in writing. In the event the committee or its <br /> designated representative fails to approve or disapprove within 20 days <br /> after written plans and specifications or any other matters requiring <br /> approval have been properly submitted to it, or in any event, if no suit to <br /> enjoin construction has been commenced prior to the completion of all <br /> improvements thereof and the issuance by the Town of Rutland of a <br /> certificate of occupancy, approval shall not be required and the related <br /> covenants shall be deemed to have been complied with fully. <br /> ARTICLE IV 4 <br /> GENERAL PROVISIONS <br /> A. TERM. These covenants are to run with the lots and shall be binding <br /> on all parties and all persons claiming under them for a period of eight <br /> (8) years from the date these covenants are recorded. <br />
