To date the Town has <br /> been on record and voted to support this request on several <br /> occasions. it is our firm hope that Dane County will approve <br /> this request, avert further confusion, and not further <br /> inconveinence Mr. Evans efforts. <br /> The area of this zoning change request is encluded in a plat, <br /> evans Subdivision Plat, which was earlier approved by the Town, <br /> Village of DeForest, and Dane County on July 6, 1990. The time <br /> period for recording expired on this request without recording <br /> and thus was resubmitted in February of 1992. A request was <br /> approved by the Town to allow lot #1 ( formally lot #5 of the <br /> Plat) to be approved to speed development. That certified survey <br /> was petition # 6660- and subject to no conditions. Zoning change <br /> request # 5209 is also not subject to any conditions by the <br /> Town of Vienna. <br /> Conditions do exist, and need to be met, prior to final recording <br /> of the Evans Subdivision Plat- BUT are not conditions of the <br /> certified survey request or Zoning Petition # 5209 . <br /> Those conditions are <br /> 1 ) Approved development agreement and Declaration of Restrictions <br /> and Covenants for that Plat <br /> 2) A letter of credit or bond to cover the cost of- road <br /> improvements, drainage and eroasion plans and costs, and utility <br /> extension costs . <br /> 3 ) A third condition has been removed from the origional request <br /> in July of 19'90. That condition was for a road easement agreement <br /> to provide access to adjoining lands. That condition was removed <br /> because the plat plan submitted February 14, 1992, listed that <br /> road as a portion of the plat and not as a possible future road. <br />
