RESTRICTIONS <br /> 1. WHEREAS, is/are <br /> the owner/s of the following described land in the Town of <br /> Dane County, Wisconsin, to-wit: <br /> Part of the NW 1/4 SW 1/4 Section 25, Town of Middleton described as. follows: <br /> Commencing at the Southwest corner of said Section 25; thence North 01° 08' <br /> 08" East along the West line of the Southwest quarter of Section 25, 2.035.54 <br /> feet; thence North 88° 47' 08" East, 210.63 feet to the point of beginning; <br /> thence North 01° 02' 30" East, 218.78 feet to the Southeasterly line of USH <br /> 12-14; thence N 76° 31' 30" East along the Southeasterly line of USH 12-14, <br /> 124.13 feet; thence S 02° 20' 00" East, 162.61 feet; thence North 89° 54' 20" <br /> West, 10.13 feet; thence S 00° 05' 40" West, 13.50 feet; thence S 89° 54' 20" <br /> East, 10.70 feet; thence S 02° 20' 00" East, 68.90 feet to the North line of <br /> Seybold Road; thence S 88° 47' 08" West along the North line of Seybold Road, <br /> 134.70 feet to the point of beginning. <br /> 2. WHEREAS, the said owner desires to place certain restrictions thereon, to <br /> bind the owner and those who may acquire title hereafter; <br /> 3. NOW, THEREFORE, in consideration of the mutual benefits passing to and <br /> from the owner and those who may hereafter purchase said land and the <br /> parties named as beneficiaries of these restrictions, the following <br /> restrictions are hereby imposed: <br /> A. The use shall be limitedto motor vehicle repairs of exhaust systems, <br /> brakes, shocks, struts and wheel alignment. <br /> These restrictions shall constitute covenants running with the land and <br /> shall be binding upon all parties now owning any part of said land, their <br /> successors, heirs and assigns, and all parties holding under them unless, <br /> pursuant to paragraphs 5 or 6 of this instrument, said restrictions are <br /> amended or terminated. <br /> 4. The restrictions provided for herein shall be enforceable at law or <br /> equity against any party who has or acquires an interest in the land <br /> subject to the restriction by the following parties who are named as <br /> grantees, promisees and beneficiaries with enforcement rights: <br /> (a) The County Government of Dane County, Wisconsin provided that the <br /> lands are under the jurisdiction of zoning ordinance of said County <br /> at the time the enforcement action is commenced; and <br />
