ORDINANCE AMENDMENT NO. 5242 Amending Section 10.03 relating to Zoning Districts in the Town of MIDDLETON The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Middleton be amended to include in the C-2 Commercial District the following described land: Pet. #5242: Part of the NW 1/4 SW 1/4 Section 25, Town of Middleton described as follows: Commencing at the Southwest corner of said Section 25; thence North 01° 08' 08" East along the West line of the Southwest quarter of Section 25, 2.035.54 feet; thence North 88° 47' 08" East, 210.63 feet to the point of beginning; thence North 01° 02' 30" East, 218.78 feet to the Southeasterly line of USH 12-14; thence N 76° 31' 30" East along the Southeasterly line of USH 12-14, 124.13 feet; thence S 02° 20' 00" East, 162.61 feet; thence North 89° 54' 20" West, 10.13 feet; thence S 00° 05' 40" West, 13.50 feet; thence S 89° 54' 20" East, 10.70 feet; thence S 02° 20' 00" East, 68.90 feet to the North line of Seybold Road; thence S 88° 47' 08" West along the North line of Seybold Road, 134.70 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. DEED RESTRICTION REQUIRED This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: A. The use shall be limited to motor vehicle repairs of exhaust systems, brakes, shocks, struts and wheel alignment. Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of the land. Failure to record the restrictions will cause the rezone to be null and void.
