o <br /> • <br /> ORDINANCE AMENDMENT NO. 5259 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> RUTLAND <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Rutland be amended to include in the A-2 <br /> Agriculture and R-1A Residential District the following described land: <br /> Part of SW 1/4 NW 1/4 Section 30, Town of Rutland described as follows: <br /> TO R-lA: Commencing at the Southwest corner of said SW 1/4 NW 1/4; thence West <br /> 50 feet to the point of beginning. Thence continue West 200 feet; thence North <br /> 327 feet; thence East 200 feet; thence South 327 feet to the point of beginning. <br /> The above listed description/s is/are intended to describe land for which a <br /> certified survey map will be prepared for approval and-recorded. This <br /> amendment will become effective, if within 90 days of its approval by the Dane <br /> County, a certified survey map that describes the land to be rezoned is <br /> recorded in the Office of the Dane County Register of Deeds. <br /> TO A-2: A parcel of land located in the SW 1/4 NW 1/4 of Section 30, Town of <br /> Rutland described as follows: Commencing at the West quarter corner of said <br /> Section 30; thence N 88° 12' East along the East-West quarter line 320.8 feet <br /> to the point of beginning. Thence continue N 88° 12' East along said East-West <br /> quarter line 640 feet more or less to a point 250 feet West of the Southwest <br /> corner of said SW 1/4 NW 1/4; thence North parallel with the East line of said <br /> SW 1/4 NW 1/4, 327 feet; thecne East parallel with said East-West quarter line <br /> 200 feet to a point 50 feet West of the East line of said SW 1/4 NW 1/4; thence <br /> North parallel and 50 feet Westerly of said East line 583 feet; thence S 87° <br /> 16' West, 197.46 feet; thence N 01° 53' 40" West, 292.99 feet; thence N 02° 54' <br /> 24" West 35.21 feet; thence S 80° 07' 41' West 773.86 feet; thence S 89° 17' <br /> 25" West 198.00 feet; thence South along the West line of said SW 1/4 NW 1/4, <br /> 190 feet mroe or less to a point that is 985 feet North of the West quarter <br /> corner of said Section 30; thence N 88° 35' East 167 feet; thence thence South <br /> parallel with the West line of said SW 1/4 NW 1/4, 750.10 feet, thence N 89° <br /> 06' East, 116.10 feet; thence S 13° 07' East, 94.00 feet; thence S 06° 38' Est, <br /> 141.9 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if'within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> A. Residential use of the A-2 zoned area is prohibited. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land. Failure to record the restrictions <br /> will cause the rezone to be null and void. <br /> EFFECTIVE DAT <br /> NAY 1 3 1992 <br />
