CONDITIONS FOR C.U.P. APPLICATION #987 <br /> 1 ) Spill containment will require a dike around the tank itself <br /> and also an overflow dike to be constructed. <br /> 2) The Town will ask that the operation be shutdown, based of <br /> proof of violation of zoning, conditional use conditions, or <br /> D.N.R. standards. <br /> 3) A, cover crop as specified in the management plan. <br /> 4) Exclusive use as a silage facility with no more than 7% ( seven <br /> percent) total vegatable by-product, by weight. <br /> 5) Site inspection by the D.N.R. at regularly schedualed <br /> intervoles. <br /> 6) Onsite inspection, on a quarterly basis, by an independant <br /> and qualified professional engineer- to be desiganated by the <br /> Town Board. Such inspections to assure compliance with all D.N.R. <br /> standards and zoning and conditional use permit requirements. <br /> The cost of inspections will be paid by the permit holder. <br /> 7) A groundwater monitering system shall be established using <br /> applicable existing wells within a 1 /2 mile radius and additional <br /> groundwater monitering wells as necessary to moniter groundwater <br /> flow and condition. <br /> 8) A bond or letter of credit in the amount of $ 50, 000. 00 shall <br /> be supplied by the permit holder to the Town of Vienna prior <br /> to and durring the periods of operation and shall be used for <br /> the construction or improvement of existing wells necessitated <br /> due to pollution from the silage operation and documentation <br /> of the source of the problem by the D.N.R. . <br /> 9) A yearly review and public hearing may be held by the Town <br /> of Vienna for the purpose of suggesting change and modification <br /> on the number of inspections required and the amount of vegatable <br /> by-product allowed. It is understood that more strict conditions <br /> will not be requested, but that positive experience may allow <br /> less severe restrictions to be applied. <br /> The Town of Vienna Board voted to recommend approval of <br /> conditional use permit number # 987 with attachment of all the <br /> conditions encluded in this letter.
