Aldworth OPPOSED: --- COMMUNICATION: Town Board <br /> Harvey/Arts to hold in abeyance until December Hearing to allow Town Board to <br /> respond. Motion carried - 4-0. <br /> #2067. Appeal by Jerry Wackett for a variance from setback from road as <br /> provided by Section 10.17(5)(b) to permit residence under construction at 837 <br /> Taft Street being Lot #55, 2nd Addition Fahey Heights - Section 24, Town of <br /> Oregon. <br /> IN FAVOR: J. Wackett OPPOSED: --- COMMUNICATION: Town Board. <br /> Quackenbush/Arts to grant variance of 9 inches from required setback <br /> right-of-way of Taft Street to allow single family residence as constructed. <br /> FINDING OF FACT: <br /> 1). Owner acted as general contractor and error was made by sub-contractor in <br /> setting basement. <br /> 2). Lot has severe slope away from road and minimal setback is critical. <br /> 3). First inspection by Zoning Department was not timely enough to catch <br /> error prior to completion of residence. <br /> CONCLUSION: <br /> 1). Variance is not contrary to rights of others or to the public interest. <br /> 2). Variance preserves the Zoning Ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 3-1. Harvey, no. <br /> #2068. Appeal by Lennes Schlobohm for a Special Exception Permit as provided <br /> by Section 11.05(3) to permit filling, grading, etc. , within 300 feet of <br /> tributary of Koshkonong Creek in the NW 1/4 NW 1/4 - Section 24, Town of <br /> Cottage Grove. <br /> IN FAVOR: A. Sandsness, K. Eilenfeldt OPPOSED: C. Brown COMMUNICATION: <br /> D.N.R. <br /> Quackenbush/Harvey to hold in abeyance until December Hearing to allow Town <br /> Board and pertinent agencies, applicable, opportunity to respond. Motion <br /> carried - 4-0. <br /> #2069. Appeal by James Poelhman, agent for John Cannarella for a Special <br /> Exception Permit as provided by Section 11.05(3) to permit filling, grading <br /> etc. , within 300 feet of Lake Mendota at 5164 Reynolds Avenue being Lot #25, <br /> Block 2, Second Ward Beach - Section 28, Town of Westport. <br /> IN FAVOR: P. Ritz OPPOSED: E. Farnsworth COMMUNICATION: Town Board <br /> Quackenbush/Harvey to hold in abeyance until December Hearing to allow parties <br /> involve to reach an accord in handling of requested permit. <br /> Motion carried - 4-0. <br /> #2070. Appeal by Gregg Miller, agent for Stuart McCormick for a variance from <br /> required setback from road as provided by Section 10.17(5)(b) to permit <br /> residence under construction at 5296 Overlook Court being Lot #18, Prestige <br /> Hills - Section 29, Town of Springfield. <br /> IN FAVOR: G.
