MINUTES OF THE MEETING OF THE DANE COUNTY <br /> BOARD OF ADJUSTMENT <br /> COMMITTEE HELD ON September 27, 1990 <br /> The following members were present: Kruschke, Harvey, Rendall and Quackenbush <br /> Also: Fleck and Reynolds. <br /> Meeting called to order at 7:05 p.m. in Room 2E City-County Building by <br /> Chairman Kruschke to hold public hearing as published by Class II Notice. <br /> Harvey/Rendall to approve minutes of August 23, 1990, with amendment and <br /> September 25, 1990. Motion carried - 3-0. Quackenbush, absent. <br /> #2028. Appeal by John Neupert, agent for Karem, Inc. for a variance from <br /> required setback from road, normal high watermark and sideyard as provided by <br /> Sections 10.17(1), 11.03(2) and 10.14(6) to permit commercial additions as <br /> constructed also for a Special Exception Permit as provided by Section <br /> 11.05(3) to permit filling, grading, etc. within 300 feet of Maunesha River at <br /> 549 Maunesha Drive in the E 1/2 NE 1/4 - Section 15, Town of Medina. <br /> IN FAVOR: D. Cheney, J. Neupert OPPOSED: M. Schmidt COMMUNICATION: <br /> D.N.R. , T. Koch <br /> Quackenbush/Harvey to hold in abeyance until October Hearing to allow <br /> applicant time to submit requested data. <br /> Motion carried - 4-0. <br /> #2029. Appeal by Keith and Lynne Gordon for a variance from required setback <br /> from road and sideyard as provided by Sections 10.17(1) and 10.06(7) to permit <br /> additions to existing residence at 1104 STH 78 So. in the NW 1/4 NW 1/4 - <br /> Section 17, Town of Perry. <br /> IN FAVOR: K. Gordon OPPOSED: -- COMMUNICATION: --- <br /> Harvey/Quackenbush to grant variances of 13 more or less feet from required <br /> setback to centerline, of STH 78 also 4 feet from required left sideyard to <br /> permit additions to existing residence. <br /> FINDING OF FACT: <br /> 1). Applicant was granted variance (1697) in May '88 for deck at same <br /> location - failed to obtain permit. 2). Proposed deck now to be porch and <br /> dormer above. 3). Existing residence as is 90% within required setback. <br /> 4). Sideyard encroachment is extension of existing line. <br /> CONCLUSION: <br /> 1). Variance preserves the Zoning Ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 4-0. <br /> #2030. Appeal by Donald Schwebs for a variance from required setback from <br /> road and sideyard as provided by Sections 10.17(4) and 10.14(6) to permit <br /> entry stairs and ramp as constructed at 4457 Second Street being Lot #12, <br /> Block #7, Village of Windsor - Section 29, Town of Windsor. <br /> IN FAVOR: D. Schwebs OPPOSED: --- COMMUNICATION: Town Board. <br />
