Applicant was required by State to install handicapped accessible <br /> entrance. <br /> 2). Project is in an area of numerous non-conforming structures and additions <br /> including some by variances. <br /> CONCLUSION: <br /> 1). Variance is not contrary to rights of others or to the public interest. <br /> 2). Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried - 4-0. <br /> #2031. Appeal by Robert Nowakowski for a variance from required setback from <br /> normal high watermark as provided by Section 11.03(2) to permit addition to <br /> existing residence at 3087 Sunnyside Street being part of Lot #1, Block #4, <br /> Monson's Park - Section 18, Town of Pleasant Springs. <br /> IN FAVOR: R. Nowakowski OPPOSED: --- COMMUNICATION: Town Board <br /> Quackenbush/Harvey to grant 4 more or less feet from required setback to <br /> normal high watermark to permit structural remodel and second story addition <br /> to existing residence. <br /> FINDING OF FACT: <br /> 1). Appeal is a re-apply of previous approval to which permit was not <br /> obtained (#1812 - 3/89 P.H.) <br /> 2). All work proposed will not exceed existing building lines. <br /> 3). Permit is to improve structural integrity and addition - not to construct <br /> a new residence. <br /> CONCLUSION: <br /> 1). Variance is necessary to provide right enjoyed by others. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 3-0. Rendall, absent. <br /> #2032. Appeal by Billy and Monna Aldrich for a variance from required <br /> sideyard as provided by Section 10.12(7) and 10.05(7) to permit enclosure of <br /> existing porch at 4370 Windsor Road in the SE 1/4 NW 1/4 - Section 29, Town of <br /> Windsor. <br /> IN FAVOR: M. Encroachment is virtually unnoticable in relation to existing building <br /> line. <br /> 2). Property is zoned A-1 thus requiring total sideyards of 25 feet with <br /> minimum 10 foot on one side. <br />
