MINUTES OF THE MEETING OF THE DANE COUNTY <br /> BOARD OF ADJUSTMENT <br /> COMMITTEE HELD ON August 23, 1990 <br /> The following members were present: Harvey, Rendall, Quackenbush and Kruschke. <br /> Also: Reynolds. <br /> Meeting called to order by Vice Chairman Harvey at 7:05 p.m. in Room 2F of <br /> City-County Building to hold public hearing as published by Class II Notice. <br /> Quackenbush/Rendall to approve minutes of 7/24, 7/26 and 8/21/90. <br /> Motion carried 3-0. Kruschke, absent. <br /> #2013. Appeal by Kegonsa Builders for a variance from required setback from <br /> road as provided by Section 10.17 (5) to permit residential garage as <br /> constructed at 1361 Pinon Trail being Lot #5, Raven Hills Plat - Section 8, <br /> Town of Oregon. <br /> IN FAVOR: P. Sveum OPPOSED: --- COMMUNICATION: --- <br /> Quackenbush/Harvey to deny requested variance from required setback from <br /> right-of-way for encroaching garage portion of new residence. <br /> FINDING OF FACT: <br /> 1) . Garage portion of newly constructed residence encroaches into required <br /> setback. <br /> 2) . Encroachment was contractor error. <br /> 3) . No physical feature or limiting factor prohibits complying location. <br /> CONCLUSION: <br /> 1) . Unnecessary hardship was not proven. <br /> Motion carried - 4-0. <br /> #2014. Appeal by Jay and Bonnie Julson for a Special Exception Permit as <br /> provided by Section 11.05 (3) to permit filling, grading, etc. , within 300 feet <br /> of Lake Kegonsa being Lot #19, Ole J. Quam's Park, at 3336 Quam Drive - <br /> Section 25, Town of Dunn. <br /> IN FAVOR: B & J Julson OPPOSED: --- COMMUNICATION: Town Board <br /> Quackenbush/Harvey to grant permit, with conditions, to fill and grade for <br /> drainage and landscape after construction of new residence. <br /> CONDITIONS: <br /> 1) . Granted as per Held & Associates plan submitted at public hearing by <br /> applicant. <br /> 2) . That plans and specifications be prepared by a licensed engineer within <br /> the scope of the application, and filed with the Zoning Department before <br /> commencement of any work. <br /> 3) . That all work be performed in compliance with approved engineering <br /> standards and applicable governmental rules and regulations particularly <br /> Section 11.05 (4) of Dane County Code of Ordinance. <br /> 4) . That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> Sly 5) . That every attempt be made to ensure the safety and livelihood of the 5 <br /> mature trees in proximity of construction area. <br />
