BOA MINUTES/8/23/90 <br /> Page 2 <br /> FINDING OF FACT: <br /> 1) . Plans and specifications were submitted by Held & Associates engineers. <br /> 2) . Applicant is attempting to alleviate drainage problems after construction <br /> of proposed residence. <br /> 3) . Engineering will ensure non-negative impact to neighbors. <br /> CONCLUSION: <br /> 1) . The project as planned with specified conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> Motion carried - 4-0. <br /> #2015. Appeal by Joseph B. Collier for a variance from required setback from <br /> road as provided by Section 10.17 (4) to permit garage addition to existing <br /> single family residence at 2026 Barber Drive being Lot #8, Richards-Standish <br /> Replat of Crown Point - Section 26, Town of Dunn. <br /> IN FAVOR: J. Collier OPPOSED: --- COMMUNICATION: Town Board <br /> Harvey/Quackenbush to grant, with condition, variance of 4 feet from required <br /> setback to Barber Drive to permit garage addition to residence as constructed. <br /> CONDITION: <br /> 1) . The addition shall be remvoed at the owner's expense if future road <br /> improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1) . Applicant has virtually no other location on lot to locate garage. <br /> 2) . Numerous similarly locatd structures in area - most non-conforming, some <br /> with variances. <br /> CONCLUSION: <br /> 1) . Variance is necessary to provide right enjoyed by others. <br /> 2) . Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 4-0. <br /> #2016.
