Barr COMMUNICATION: Town <br /> Board. <br /> Harvey/Quackenbush to deny special exception permit as neighbors spoke in <br /> opposition and applicant did not provide supporting engineering data. <br /> Motion carried - 4-0. <br /> Quackenbush/Rendall to deny requested sideyard variance. <br /> FINDING OF FACT: <br /> 1) . Applicant failed to appear. <br /> 2) . Site plan provided by owner indicated minimum sideyards would be met. <br /> 3) . Neighbors spoke in opposition of encroachment. <br /> 4) . Structure could have been located in complying location. <br /> CONCLUSION: <br /> 1) . Unnecessary hardship was not proven. <br /> Motion carried - 4-0. <br /> #2019. Appeal by Leonard Faust for a variance from required setback from <br /> normal high watermark as provided by Section 11.03 (2) to permit addition to <br /> existing residence at 2703 Tower Road in the SE 1/4 SE 1/4 - Section 8, Town <br /> of Dunn. <br /> IN FAVOR: L. Faust OPPOSED: --- COMMUNICATION: Town Board <br /> Rendall/Harvey to hold in abeyance until September Hearing to allow applicant <br /> opportunity to reduce requested variance. Motion carried 4-0. <br /> #2020. Appeal by Daniel Peterson for a variance from required sideyard and <br /> setback from normal high watermark and maximum height of accessory building as <br /> provided by Sections 10.16 (6) , 10.07 (3) and 11.03 (3) to permit addition to <br /> existing boathouse and also for a Special Exception Permit as provided by <br /> Section 11.05 (3) to permit filling, grading, etc. , within 300 feet of Lake <br /> Kegonsa at 2162 Colladay Point Drive being Lot #27, Colladays Point - Section <br /> 23, Town of Dunn. <br /> IN FAVOR: D. Peterson OPPOSED: G. Grosshauer COMMUNICATION: Department <br /> of Natural Resources, Town Board. <br /> Quackenbush/Harvey to hold special exception permit request until September <br /> Hearing pending further information. Motion carried - 4-0. <br /> Quackenbush/Rendall to grant 2 inch intrusion into required right sideyard to <br /> allow decking with a 6 inch maximum height over existing boathouse. <br /> FINDING OF FACT: <br /> 1) . Applicant has withdrawn plans for screen enclosure over boathouse and now <br /> proposed open deck instead. <br /> 2) . Handrail around decking is permitted. <br /> 3) . Neighbor no objection provided view of lake is not impeded. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2) . Variance is necessary to provide right enjoyed by others. <br /> Motion carried - 4-0. <br /> #2021. Appeal by Ron Anderson for a variance from required sideyards and <br /> setbacks from normal high watermark as provided by Sections 10.07 (7) , 10.16 (5) <br /> and 11.03 (2) - additions to existing residence at 3434 Mallard Avenue being W <br /> 1/2 Lot #1, Rock Elm Park - Section 26, Town of Dunn. <br />
