Appeal by Oakwood Builders , agent for Steve and Judy Householder for a <br /> variance from required setback to normal high watermark as provided by Section <br /> 11 .03(2) to permit deck addition to proposed residence also, for a Special <br /> Exception Permit as provided by Section 11 .05(3) to permit filling, grading, <br /> etc., within 300 feet of Six Mile Creek at 5636 Tall Oaks Road in the NW 1/4 <br /> NE 1/4 - being Lot #90, 1st Addition Mary Lake - Section 21 , Town of Westport. <br /> IN FAVOR: B. Quamme, S. Pederson, J. Householder OPPOSED: --- <br /> COMMUNICATION: --- <br /> Quackenbush/Harvey to grant Special Exception Permit with conditions , to allow <br /> fill/grade and retaining walls in conjunction with new home construction as <br /> per plans submitted. <br /> CONDITIONS: <br /> 1 ). That plans and specifications be prepared by a licensed engineer within <br /> the scope of the application, and filed with the Zoning Department before <br /> commencement of any work. <br /> 2). That all work be performed in compliance with approved engineering <br /> standards and all applicable governmental rules and regulations particularly <br /> Section 11 .05(4)• of Dane County Zoning Ordinance. <br /> 3) . That there be filed with the Zoning Ordinance a certificate of compliance <br /> by a licensed engineer at the completion of the project. <br /> 4). Permit valid for 6 months from issue. <br /> FINDLNG OF FACT: <br /> 1 ). Project has professional engineering data submitted. <br /> 2). Request is similar to several permits, in immediate area, which were <br /> already granted. <br /> 3). Steep slope levees not virtually unbuildable without site preparation. <br /> CONCLUSION: <br /> 1 ). The project as planned, with specified conditions ; will not result in <br /> substantial detriment to navigable waters by erosion , sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> Motion carried - 3-0. <br /> Also, Quackenbush/Harvey to hold in abeyance variance request pending <br /> submittal of Town response and investigating alternatives to variance - <br /> abeyance until August Hearing. <br /> Motion carried - 3-0. <br /> Appeals from previous hearings: <br /> #1931 .
