BOA Minutes/6/28/90 <br /> Page 5 <br /> IN FAVOR: D. Johnson, W. Knox OPPOSED: --- COMMUNICATION: Town Board, <br /> County Highway. <br /> Quackenbush/Rendall to grant, with conditions, variance of 14 feet from <br /> required setback from right-of-way CTH AB to permit deck and step addition to <br /> existing single family residence. <br /> CONDITIONS: <br /> 1) . The structure shall be removed at the owners expense if future road <br /> improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1) . Other residences and structures closer to road. <br /> 2) . Addition is 10 more or less feet below road grade. <br /> 3) . Deck will extend 4 feet either side of residence. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 4-0. <br /> #1996. Appeal by Yahara Builders, agent for Donald Wahlin for a variance from <br /> required setback from road, setback from normal high watermark and maximum of <br /> lot coverage as provided by Sections 10.17(4) , 11.03 (2) and 10.07 (5) to permit <br /> construction of new single family residence at 1983 Skyline Drive being Lot <br /> #10, Cottage Park - Section 30, Town of Pleasant Springs. <br /> IN FAVOR: B. Wolff OPPOSED: R. Jacobson COMMUNICATION: Town Board <br /> Harvey/Rendall to hold in abeyance until July public hearing to allow <br /> communication from town regarding disposition of lands designated as "park" on <br /> Plat of Cottage Park. ' <br /> Motion carried - 4-0. <br /> #1998. Appeal by Edward A. Solner to the Dane County Board of Adjustment for <br /> determination of the validity of the interpretation of the Dane County Zoning <br /> Administrator as pertains to the following. <br /> provisions of the Dane County Zoning Ordinance: <br /> 1) . 10.01(25) Home occupation. <br /> 2) . 11.05 Filling/grading etc. in shoreland area. <br /> IN FAVOR: E. Solner, Attorney A. Varda OPPOSED: M. Gerner, C. Gerner <br /> COMMUNICATION: ---. <br /> Zoning Administrator William Fleck and Attorney B. Kaufmann spoke regarding <br /> interpretation of statutory requirements. <br /> Appellants withdrew request regarding home occupation. <br /> Harvey/Quackenbush to refuse jurisdiction of Zoning Administrator's <br /> interpretation of compliance with conditions of Special Exception Permit #1832. <br /> Motion carried - 4-0. <br /> #2000. Appeal by Doc Electric, Inc. for a variance from required sideyard as <br /> provided by Section 10.11(6) to permit reconstruct of building at 875 USH 51 <br /> in the NE 1/4 NE 1/4 - Section 9, Town of Dunkirk. <br /> IN FAVOR: J. Oler, D. Dennis OPPOSED: --- COMMUNICATION: Town Board. <br /> Harvey/Rendall to grant variance of 7 feet from required right sideyard to <br /> permit reconstruction of existing burned out building. <br />
