BOA Minutes/6/28/90 <br /> Page 6 <br /> FINDING OF FACT: <br /> 1) . Building has substantial foundation wall which survived fire. <br /> 2) . Structure will extend no nearer than does remaining portion or portion <br /> destroyed by fire. <br /> 3) . No objections were received. <br /> CONCLUSION: <br /> 1) . Variance is not contrary to rights of others or to the public interest. <br /> 2) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 3-0 Quackenbush, absent. <br /> Petitions from previous hearings: <br /> #1931. Ballweg - Roxubury - 12/21/89 P.H. <br /> Harvey/Quackenbush to request input and permit from Department of Natural <br /> Resources also schedule for July inspection trip. <br /> Motion carried - 4-0. <br /> Quackenbush/Harvey to hold in abeyance not beyond August Hearing. Lindholm <br /> Harvey/Rendall to grant with conditions variance of 17,360 square feet from <br /> required lot area also grant variance of 17 stalls from number of stalls <br /> required to permit motel conversion to (18) single occupancy one room <br /> efficiencies and (3) 2 person occupancy units. <br /> CONDITIONS: <br /> 1) . Variances granted to permit not more than (3) two person dwelling units, <br /> with the balance being single occupancy units, of the 21 total allowable units. <br /> 2) . Review in 1 year (June 1991) of Condition #1 (above) for compliance and <br /> workability of variances granted. <br /> FINDING OF FACT: <br /> 1) . Property has conditional use permit granted for multi-family use. <br /> 2) . Structure was utilized as motel. <br /> 3) . Historically, low to moderate income tenants do not own vehicles but rely <br /> on mass transit. <br /> 4) . Project is financed by rental rehabilitation loan program which dictates <br /> 70% of units rented to low or moderate income tenants. <br /> CONCLUSION: <br /> 1) . Variance is necessary to provide right enjoyed by others. <br /> 2) .
