Without expert identification, the aerial photograph dated 4/1/68 M submitted by the applicant is inconclusive. CONCLUSION: 1) . That the pertinent Dane County ordinances applicable hereto were effective 5/27/68; that the applicable provisions of Dane County Ordinance 10.12 (1) (c) (4) then in effect and as pertain to working and registering the nonconforming mineral extraction operation of the Marty Pit located in the SE 1/4 NW 1/4 - Section 9, Town of Verona, were complied with an it is a valid nonconforming use. 2) . That said nonconforming use status extends, as interpreted by the Dane County Zoning Administrator on 10/17/89, to the adjacent NE 1/4 NW 1/4 - Section 9, Town of Verona by virtue of the decision in Sturges 141 Wis. 2d 149 (1987) and the prior decision of this Board of Adjustment, Appeal Number 926 (1980) by which precedent this Board of Adjustment is bound. 3) . That the applicant's appeal of the Dane County Zoning Administator's interpretation of all matters herein is denied. Motion carried - 5-0. Petitions from previous hearings: F #1931.
