Any change in use or in volume of <br /> traffic will void the variance. <br /> FINDING OF FACT: <br /> 1 . this is a specialty store operation not subject to normal retail <br /> traffic. <br /> 2 . zoning ordinance does not take such uses into consideration but <br /> regulates in a general fashion. Thus most businesses will be <br /> required to have adequate parking but others could have less than <br /> or more than is necessary for their specific use . <br /> 3. condition imposed will assure that change of use with increased <br /> traffic will have to provide adequate parking. <br /> 4. recent highway improvement took a portion of this property for road <br /> right-of-way which reduces the area available for parking. <br /> CONCLUSION: <br /> 1 . proven case of unnecessary hardship. <br /> 2. variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 3. variance is not contrary to rights of others or to the public <br /> interest. <br /> 4. hardship is caused by the ordinance and is not self-imposed. <br /> (111, Motion carried 4-0. <br /> 5); REQUEST FOR RECONSIDERATION: <br /> a) . Turner - Madison - P.H. 2/22/90 - (Denied) . <br /> Quackenbush/Harvey grant reconsideration and allow reapplication within <br /> one year of denial based on evidence of change in circumstances; <br /> 1 . new duplex has been recently built in close proximity <br /> 2. Town Board is now in favor of allowing duplexes on subject property <br /> 3. request is not a variance but is for removal of a condition imposed by <br /> the Board of Adjustment and unnecessary hardship is not a factor. <br /> Motion carried 4-0. <br /> b) #1937 . Johnson - Dunn/ request denied 2/22/90 <br /> Harvey/Quackenbush allow reapplication within one year of denial based on <br /> defective notice to applicant. Notice was sent to renter of property and <br /> Mr. Johnson was not aware of hearing. <br /> Motion carried 4-0. <br /> c) #1938.
