dcovBOA MINUTES/2/22/90 <br /> Page 2 <br /> CONDITIONS: <br /> I T I O_N_S: <br /> 1) . —Permit is expressly for spreading of existing deposited materials - no <br /> additional materials maybe dumped or leveled. <br /> 2) . Applicant shall request inspection by Dane County Zoning upon completion <br /> of project. <br /> 3) . This permit shall expire June 1, 1990. <br /> FI_NDIN_G_OF FACT: <br /> 1) . Spoils are from previous tributary to Maunesha River, excavation done by <br /> former property owner. <br /> 2) . Spoils have "berming effect" which prohibit surface drainage away from <br /> buildings and cause ponding. <br /> 3) . Permit acquisition is part of settlement with Dane County Corporation <br /> Counsel. <br /> CONCLUSION: <br /> 1) . The project as planned, with specific conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> Motion carried - 4-0. <br /> #1947. Wiegand - Dunn. <br /> Harvey/Rendall to grant, with condition, variance of 13.5 more or less feet <br /> from required setback to normal high watermark to permit residential and deck <br /> addition to existing building. <br /> C_O_NDITI_ON: <br /> 1) . Deck addition shall not extend nearer to normal high watermark than does <br /> existing residence. <br /> FINDING OF FACT: <br /> 1) . Applicant removed second residence from property and opted to enlarge <br /> existing residence. <br /> 2) . Property is in an area of numerous nonconforming structures and numerous <br /> setback variances. <br /> 3) . Public sewer is available to property. <br /> CONCLUSION: <br /> 1) . Variance is necessary to provide right enjoyed by others. <br /> 2) . Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 4-0. <br /> #1948. Haas - Middleton. <br /> Harvey/Quackenbush to grant, with condition, variance of 34.5 more or less <br /> feet from required setback to right-of-way of CTH "S" (Mineral Point Road) to <br /> permit second story addition over existing structure and admonishes applicants <br /> for construction prior to permits. <br /> C_O_N_DITIO_N: <br /> 1) . The addition shall be removed at the owner 's expense if future road <br /> improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1) . Addition constructed without any required permits. <br /> 2) . Addition encroaches no further into required setback than does existing <br /> lower level. <br /> 3) . County Highway has expanded right-of-way there already and plans no <br /> further widening in the near future. <br />
