BOA/MINUTES/2/22/90 <br /> Page 3 <br /> CONCLUSION: <br /> 1 ). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 4-0. <br /> #1949. Turner - Madison. <br /> Rendall /Harvey to deny requested lot area variances to permit construction of <br /> (2 ) duplexes on (2 ) lots which were created by previous variance for the <br /> express purpose of constructing single family residences. <br /> FINDING OF FACT: <br /> 1 ) . Variance #1711 , of May 1988, was granted to permit creation of (2 ) single <br /> family residential lots within the Shoreland District. <br /> 2 ) . Applicant now wishes to construct duplexes on subject lots to maximize <br /> investment return. <br /> 3) . Town Board recommends approval while 2 neighbors spoke in opposition. <br /> 4) . Error in requested amount of square footage (required: 15 ,000 square <br /> foot minimum lot area) noted and consideration reflects that figure. <br /> CONCLUSION: <br /> 1 ). Unnecessary hardship was not proven . <br /> Motion carried - 5-0. <br /> #1950. Coyle Carpet - Madison. <br /> Quackenbush/Rendall to separate issues and to hold variance from required <br /> number of parking stalls in abeyance until March Hearing pending further study. <br /> Motion carried - 4-0. <br /> Quackenbush/Harvey to grant, with conditions , variance of 5 more or less feet <br /> from required right sideyard and to grant variance of 26 more or less feet <br /> from required right-of-way setback to permit second story addition over <br /> existing building. <br /> CONDITIONS: <br /> 1 ) . Second story, with exception of 6 inch overhang at bottom and an <br /> additional 12 inch overhang at top of addition for drainage purposes , will <br /> extend no further into required setback than existing structure. <br /> 2) . Existing 5 more or less feet canopy to be removed. <br /> FINDING OF FACT: <br /> 1 ). State code requiring firewalls necessitate minimal further encroachment <br /> into required setback . <br /> 2 ). All additions are to second story. <br /> 3) . Addition is necessary for employee office area . <br /> 4 ) . Variance granted in 1966 for first floor. <br /> CONCLUSION: <br /> 1 ) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2 ) . Variance is necessary to provide right enjoyed by others. <br /> Motion carried - 4-0. <br /> Petitions from previous hearings: <br /> kre #1903. Snittler - Montrose - 9/28/89 P.H. <br /> Quackenbush/Harvey to hold in abeyance until March public hearing to allow <br /> proposed road vacation to clear County Board therefore not requiring variance. <br /> Motion carried - 4-0. <br />
