. • • • . <br /> property in the neighborhood for purposes <br /> already permitted will not be substantially <br /> impaired or diminished by the establishment, <br /> maintenance or operation of the Airport as <br /> required by § 10.255(2)(h)1 of the Dane County <br /> Code of Ordinances. <br /> (3) The action of the Zoning & Natural Resources <br /> Committee was arbitrary and capricious in that <br /> (a) it ignored uncontroverted evidence concerning <br /> the safety of the proposed Airport and its impact <br /> upon the marketability and value of properties in <br /> the area, (b) it ignored the recommendation of the <br /> Springdale Town Board that the Application be <br /> denied, (c) it ignored a petition signed by most of <br /> the adult population of the Town of Springdale <br /> submitted in opposition to the Application, and <br /> (d) it lacked any rational basis. <br /> (4) The establishment, maintenance, or operation of <br /> the Airport may be detrimental to or endanger the <br /> public health, safety, comfort, or general <br /> welfare. <br /> (5) The establishment, maintenance or operation of <br /> the Airport will substantially impair or diminish <br /> the uses, values and enjoyment of other property <br /> in the neighborhood for purposes already <br /> permitted. <br /> Each of the Appellants is aggrieved by the decision of the Zoning & <br /> Natural Resources Committee because (a) they own property which <br /> adjoins that of Kenton Kilmer and will be within the traffic pattern <br /> of the Airport, (b) the Airport will diminish the value of their <br /> property, (c) the Airport will substantially diminish the uses, value <br /> and enjoyment of their properties and of properties in the <br /> neighborhood, (d) the establishment, maintenance, or operation of the <br /> Airport will be detrimental to or endanger the public health, safety, <br /> comfort, or general welfare, and (e) the Airport is inconsistent with <br /> the Land Use Plan adopted by the Town of Springdale. <br /> WHEREFORE Appellants request that the County Board reverse the <br /> decision of the Zoning & Natural Resources Committee and order that <br /> the application of William K. Garfoot on behalf of Kenton Kilmer for <br /> garfoot.000 2 <br />
