ORDINANCE AMENDMENT NO. 5368 Amending Section 10.03 relating to, Zoning Districts in the Town of BURKE The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Burke be amended to include in the C-2 Commercial District the following described land: Part of the NE 1/4 NW 1/4 Section 5, Town of Burke described as follows: Commencing at the North quarter corner of said Section 5; thence S 01° 25' 30" West, 589.30 feet and the point of beginning; thence continuing S 010 25' 30" West, 482.54 feet to the North line of Lot #3, Certified Survey Map #6557, Volume 32 of Certified Survey Maps, Pages 123 - 125; thence S 89° 11' 44" West, 678.31 feet; thence N 000 48' 16" West, 486.46 feet; thence N 89° 32' 53" East, 697.09 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. DEED RESTRICTION REQUIRED This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: A. Development on this property shall adhere to the following: (1) SETBACK REQUIREMENTS (a) Building setbacks shall be in accordance with Dane County Ordinance except as modified herein. (b) Buildings shall be a minimum of 75 feet from property lines along I-90-94 and the ramp. (c) Buildings shall be a minimum of 15 feet from a side lot line. (d) Parking lots shall be a minimum of 20 feet from the property lines along I-90-94. (e) Parking lots shall be a minimum of 15 feet from the property lines along local streets. (f) Parking lots shall be a minimum of 7 feet from a side lot line and rear lot line. (2) LOT COVERAGE (a) The building and parking shall not cover more than 80% of the total lot.
