MINUTES OF THE MEETING OF THE DANE COUNTY <br /> BOARD OF ADJUSTMENT <br /> COMMITTEE HELD ON October 22, 1992 <br /> The following members were present: Quackenbush, Dreps, Lynch and Gaskill <br /> Also: Fleck and Reynolds. <br /> Meeting called to order at 6:30 p.m. in Room 2I by Chairman Quackenbush to <br /> hold public hearing as published by Class II Notice. <br /> Appeals from previous hearings: <br /> #2270. Essert - Westport - 6/25/92 P.H. <br /> Gaskill/Dreps to hold in abeyance until December Hearing to allow applicant to <br /> resolve septic issues with Dane County Environmental Health Department. <br /> Motion carried - 3-0. <br /> #2275. Guries - Oregon - 7/23/92 P.H. <br /> Applicant appeared at public hearing and requested his appeal be withdrawn as <br /> road vacating will remove necessity for variance. <br /> #2299. Merry 31 /24/92 P.H. <br /> Dreps/Lynch to grant, with conditions, permit to fill and grade for road <br /> construction to access property. <br /> CONDITIONS: <br /> 1). That plans and specifications be prepared by a licensed engineer within <br /> the scope of the application, and filed with the Zoning Department before <br /> commencement of any work. <br /> 2). That all work be performed in compliance with approved engineering <br /> standards and all applicable governmental rules and regulations particularly <br /> Section 11.05(4) of Dane County Ordinance. <br /> 3). That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> 4). Review and certification by Dane County Zoning that Fall/Winter <br /> stabilization is in place sufficient for disturbed areas to endure spring <br /> thaws. <br /> 5). Final completion and certification by July 1, 1993. <br /> FINDING OF FACT: <br /> 1). Applicant proposes to construct road/driveway to access proposed <br /> residence and crops. <br /> 2). A small portion of project comes within 300 feet of Token Creek. <br /> 3). Project will not infringe into wetland or flood zone areas. <br /> 4). Engineering and certification by Vierbicher & Associates plan dated <br /> 9/16/92 and numbered 920-L. <br /> CONCLUSION: <br /> 1). The project as planned, with specified conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> Motion carried - 3-0. <br /> #2302. Barth - Windsor - 9/24/92 P.H. <br /> Appearance J. Barth. <br /> Gaskill/Lynch to grant variance of 25 feet from required setback to normal <br /> hight water mark to permit both, garage/carport addition to existing residence <br /> and also to construct storage building not nearer than 50 fet to normal high <br /> watermark. <br />
