Stoop/deck will not have stairs or access to ground. <br /> CONCLUSION: <br /> 1). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is necessary to provide right enjoyed by others. <br /> #2313. Appeal by Duane Hinchley, agent for Keith Hinchley for a variance from <br /> required setback from road as provided by Section 10.17(1) to permit barn <br /> addition as proposed at 2844 STH 73 in the NW 1/4 NW 1/4 - Section 10, Town of <br /> Christiana. <br /> IN FAVOR: D. Hinchley, K. Hinchley OPPOSED: --- COMMUNICATION: Town <br /> Board. <br /> Gaskill/Lynch to grant, with condition, variance of 54 feet to centerline of <br /> STH 73 to permit 52 x 70 addition to existing barn. <br /> CONDITION: <br /> 1). The structure shall be removed at the owner's expense if future road <br /> improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1). Addition is needed to continue existing dairy operation and layout of <br /> existing facilities necessitate proposed location. <br /> 2). Tobacco shed of substantial size encroaches into right-of-way in close <br /> proximity to proposed structure. <br /> 3). Proposal is to include barn and milkhouse addition. <br /> CONCLUSION: <br /> 1). Variance is not contrary to rights of others or to the public interest. <br /> 2) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> Motion carried - 3-0. <br /> #2314. Appeal by Keith Frederickson for a variance from required setback from <br /> road as provided by Section 10.17(2) to permit entry addition/replacement to <br /> existing single family residence at 3429 CTH BB in the NE 1/4 SW 1/4 - Section <br /> 12, Town of Blooming Grove. <br /> IN FAVOR: K. Frederickson OPPOSED: --- COMMUNICATION: --- <br /> Lynch/Gaskill to grant variance of 9 more or less feet from required setback <br /> to right-of-way of CTH BB to permit replacement of entryway to existing <br /> residence. <br /> CONDITION: <br /> 1). Entry structure limited to 4' x 4' platform and location as proposed. <br /> FINDING OF FACT: <br /> 1). This structure replaces entry removed due to unsafe conditions. <br /> 2). Addition will not extend into required setback as near as existing <br /> residence. <br /> 3). Virtually most of existing residence is within required setback. <br /> CONCLUSION: <br /> 1). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 3-0. <br /> #2315. Appeal by LaVelle Holley for a Special Exception Permit as provided by <br /> Section 11.05(3) to permit filling, grading, etc. , within 300 feet of Lake <br /> Kegonsa at 2228 Colladay Point Drive being Lot #3, Harriet Colladay <br /> Subdivision - Section 23, Town of Dunn. <br />
