MINUTES OF THE MEETING OF THE DANE COUNTY <br /> BOARD OF ADJUSTMENT <br /> COMMITTEE HELD ON September 24, 1992 <br /> The following members were present: Gaskill, Lynch, Quackenbush and Dreps. <br /> Also: Fleck and Reynolds. <br /> Meeting called to order at 6:30 P.M. in Room #2E by Chairman Quackenbush to <br /> hold public hearing as published by Class II Notice. <br /> MINUTES: Gaskill/Dreps to approve minutes of 8/27 and 9/17/92. Motion <br /> carried 3-0. <br /> #2273. Appeal by City of Madison for a variance from required setback from <br /> road as provided by Section 10.17(3) to permit canopy construction over <br /> existing tank at 902 Wheeler Road in the SW 1/4 SW 1/4 - Section 24, Town of <br /> Westport. <br /> Appearance: G. Dreckmann <br /> Lynch/Dreps to hold request in abeyance until November Hearing to allow City <br /> of Madison and Town of Westport to resolve outstanding issues. <br /> Motion carried - 3-0. <br /> #2290. Appeal by John Weber for a variance from required setbacks from normal <br /> high water mark and side yard as provided by Sections 11.03(2), 10.16(6)(a) <br /> 1., and 10.07(7) to permit existing boathouse and existing and proposed <br /> additions to residence and also for a Special Exception permit as provided by <br /> Section 11.05(3) to permit filling, grading, etc. , within 300 feet of Lake <br /> Kegonsa at 2224 Colladay Point Drive being Lot #1, Harriet Colladay <br /> Subdivision - Section 23, Town of of Dunn. <br /> Appearances: J. Weber, L. Kovaric COMMUNICATION: Town Board <br /> Variance: Gaskill/Lynch to grant variance of 11.9 feet from required average <br /> setback to normal high watermark to permit a 4' x 20' deck addition to <br /> residence to run a total of 20 lineal feet across front of existing <br /> residence. Also, to grant variance of 7.9 feet from required average setback <br /> to normal high watermark to permit deck addition to left side of residence <br /> which will extend no nearer to normal high watermark than existing residence; <br /> also, to grant a variance of 7.9 from required average setback to normal high <br /> watermark to permit ar. structural alterations, basement walk-out included, as <br /> exists. <br /> Motion carried - 3-0. <br /> Gaskill/Dreps to deny variance of 2.5 feet from required left sideyard to <br /> permit deck addition to left side of residence. Motion carried - 3-0. <br /> Gaskill/Dreps to hold Special Exception Permit request in abeyance for up to 6 <br /> months to allow township to incorporate Mr. Weber's project into plans to cure <br /> drainage problems with culverts and holding ponds in that portion of Colladay <br /> Point. <br /> Motion carried - 3-0. <br /> FINDING OF FACT: <br /> 1). Applicant had similar variances approved (Special Exception and Variance <br /> #2161 from 9/26/91) but survey showed significant changes in distances from <br /> owner's measurements. <br /> ,r✓'e 2). Existing cottage had been added onto numerous times. <br /> 3). Deck (4 x 20) across front allows emergency exits and for window cleaning. <br /> 4) . Fill and grade is to alleviate standing water on property - however <br /> filling property would have effect of forcing water to adjoining properties or <br /> to stand on Town Road. <br />
