BOA 12/17/92 Minutes <br /> Page 3 <br /> Moved to end of agenda. <br /> #2338. Appeal by Jean E. Engel for a variance from required sideyard as <br /> provided by Section 10.07(7) to permit structural alteration of existing <br /> residence as constructed at 3303 Quam Drive being Lot #20, Kegonsa Heights - <br /> Section 25, Town of Dunn. <br /> IN FAVOR: J. Engel, L. Mathewson OPPOSED: --- COMMUNICATION: Town Board. <br /> Lynch/Gaskill to grant variance of 4 more or less feet from required sideyard <br /> to permit structural alteration of existing residence as constructed. <br /> FINDING OF FACT: <br /> 1). Appelant had obtained a zoning permit utilizing a site plan showing <br /> sufficient sideyard. <br /> 2). Subject property is bound by road frontage on 3 of 4 sides. <br /> 3). Footprint of structure does not change only roof removal and replacement. <br /> 4). Original roof had insufficient pitch to allow proper drainage thusly <br /> repair necessitates reconstruct roof with 4/12 pitch, . <br /> CONCLUSION: <br /> 1). Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is necessary to provide right enjoyed by others. <br /> Motion carried - 3-0. <br /> #2339. Appeal by Terri Beglinger for a Special Exception Permit as provided <br /> by Section 11.05(3) to permit filling, grading, etc. , within 300 feet of Lake <br /> Kegonsa at 2036 Barber Drive being Lot #4, Richards-Standish Replat of Crown <br /> Point Section 26, Town of Dunn. <br /> IN FAVOR: T. & T. Berginger OPPOSED: -- COMMUNICATION: Town Board. <br /> Gaskill/Lynch to grant, with conditions, permit to fill, grade and retaining <br /> wall as constructed in conjunction with new garage being erected. <br /> CONDITIONS: <br /> 1). That plans and specifications be prepared by a licensed engineer within <br /> the scope of the application, and filed with the Zoning Department before <br /> commencement of any work. <br /> 2). That all work be performed in compliance with approved engineering <br /> standards and all applicable governmental rules and regulations particularly <br /> Section 11.05(4) of Dane County Zoning Ordinance. <br /> 3). That there be filed with the Zoning Department a certificate of <br /> compliance by a licensed engineer at the completion of the project. <br /> FINDING OF FACT: <br /> 1). Garage constructed under Zoning Permit #29-2175 was raised to be at grade <br /> with highway. <br /> 2). Fill and retaining structure, needed to bridge low area between garage <br /> and road. <br /> 3). Engineering data provided by Nickolas George, professional engineer. <br /> 4). Project has effect of slowing run-off from road and channels water <br /> effectively towards lake. <br /> CONCLUSION: <br /> 1). The project as planned, with specified conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> Motion carried - 3-0. <br />
